19.01.2022 Dont be complacent in obtaining information when you are involved in an accident: - While we would like to believe that people act in good faith and provide their insurance company the precise version of events after an accident, there are some who provide pure conjecture. Unfortunately, the onus is always on the non at fault party to prove their innocence in this situation. Nonetheless what may seem to you as conclusive may be construed to imply you were at fault. The mai...n motivation by the other party is to avoid payment of excess which could be as high as $2,500.00. There are many instances of such disparity for example. Our client was slowing down to stop on a busy highway, embanked with traffic when suddenly their vehicle was hit in the rear. The other party provided a version of events to their insurance company, which contradicted our clients version, implying that our client had cut into their lane causing the accident. Fortunately, our clients vehicle was fitted with a dashcam, it showed that the other party was in the right-hand lane attempting to enter the middle lane where our client was traveling. The footage showed that the other party was not traveling at a safe distance when attempting to enter the middle lane. The footage also showed that our client had to stop suddenly due to traffic causing the other party to misjudge their entry into the middle lane, impacting our clients vehicle. While our client was fortunate to have installed a dashcam to support their claim, there are many unfortunately non at fault parties have had to bear inconclusive the decision. Resulting in each party bearing their own costs. A good result for the insurance companies, whereby each party is required to pay there excess and their respective insurance companies only have to pay the damages of their client. Not a really a good result for the innocent party.

04.01.2022 Things to Know When You Have an Accident and the other party is at fault. Stay composed, do not engage in any confrontation with the other party. If the other party is abusive call the police.... Exchange details by taking photos of each others drivers license front and back in case the address has changed. Make sure you obtain their contact details, if they have a mobile phone with them take it down and then call it to make sure it rings. Take lots of photos of the area where the accident took place. Such as traffic lights, intersections, Giveaway and Stop signs, position of the vehicle before moving it aside and whether the condition of the road was visible. Video is sometimes better. If possible, draw the accident scene on paper and make the other party sign it as a true version of events. Take photos of your damage and damage to the at fault vehicle. If you have a dash cam make sure you take a copy before erasing the memory. Obtain the at faults insurance details. Advise them that you will be calling them within the next few days to obtain a claim number.
