19.01.2022 Mother’s Day Sunday 8 May 2016 Mothers come in all different sizes and shapes, ages and nationalities. Some mothers are soft and compassionate, with a soothing and calm voice. Other mothers are fiery and outspoken, with a commanding presence and firm attitude. Whatever type of mother you have ( or are yourself) it is important to remember how special the bond is between parent and child. ... The relationship between mother and child is not always smooth sailing. Children test their mother’s patience and as the child becomes an adult, the mother often tests the child’s patience. Over the passage of decades sometimes the roles of parent and child reverse. The child may well become the mother figure, the mother then reaching out to the child for help and support. There have been many famous mothers over the course of history. One of the more famous mothers did not ever give birth. However, she was well known for her insightful and thought provoking quotes and advice. Mother Teresa said very aptly: If you judge people, you have no time to love them, and Loneliness is the most terrible poverty. On Mother’s day this Sunday, mothers and children alike should remember Mother Teresa’s words and turn to each other for love , comfort and peace.

15.01.2022 Swimming and Spa pools How could these words be relevant to you? They certainly are, if you have a swimming pool or spa or are about to buy or rent a property which has one. The existence of a swimming pool or spa pool at your home is also relevant in family law matters. New regulations regarding swimming and spa pools in NSW come into effect on 26 April 2016. All properties with a swimming pool or spa pool being sold or rented on or after this date will need a certificat...e of compliance or an occupation certificate. If the certificate cannot be obtained by the seller, they will be able to transfer the obligation to obtain one to the buyer. The new regulations will not apply to the majority of sale contracts and/or rental agreements relating to strata properties. So, where is the relevance to family law matters? As the new regulations apply to contracts for the sale of property and many property settlement disputes are resolved by the home or investment property sold, the relevance is clear. As a separated person dealing with an unresolved property matter, it would be prudent to consider right now whether you should apply for the soon to be compulsory certificate of compliance. Experts are suggesting it is likely 95% of existing spas and pools will fail the initial inspection. Numerous Councils have said it can take up to 90 days before a non-compliant spa or pool becomes compliant. Check the NSW Swimming Pool Register to see if the relevant property already has a current certificate of compliance. Enquiries can also be made of your Local Council.

12.01.2022 What passing- bells for those who die as cattle? These are the words of the poet Wilfred Owen, who was killed in the trenches of France in World War One a week before the Armistice Agreement was signed in 1918. Wilfred Owen wrote these words whilst watching his comrades die believing no one noticed their passing or cared. ANZAC day is a day to show that we do care and we do remember. I have a confession to make. As a child I decided I was a pacifist and that war was wrong.... And I thought that ANZAC day was a celebration of war. And so, in my young self-righteous way, I refused to attend ANZAC day services with my grandfather who was an engineer in the Airforce in World War II, stationed in Townsville. I refused to listen to stories about Great- Great Uncle Larry, who disappeared, assumed dead, in the area of Passchendale in World War One. I didn’t want to know. I thought that any recognition of those who had given their lives was in some way a celebration of war and therefore wrong. I know better now and I am ashamed of my previous attitude. I still hate war, but I know that life isn’t as simple as we would sometimes like to be. I understand now that ANZAC day is not a celebration of war but is about remembering those who paid the ultimate price and sacrificed their lives so that future generations could live in a peaceful, democratic society. These weren’t the people who caused war. These were ordinary people, like you and me, who each believed that their individual lives were worth giving so that their homeland could be free. Another poet, Laurence Binyon wrote one of the most poignant odes to the fallen in war, a part of which is often quoted on ANZAC day: They shall grow not old, as we that are left grow old; Age shall not weary them, nor the years condemn. At the going down of the sun and in the morning We will remember them. On ANZAC day we do remember them. Those passing bells of which Wilfred Owen spoke, they will be the bugles playing the Last Post at the Dawn Services around Australia. Lest We Forget.

08.01.2022 Its Crazy Time Again Yes, the NSW school holidays have commenced and continue right through until the school bell rings on Tuesday 26 April 2016. Monday 25 April 2016 is not a pupil free day. It is Anzac Day - the 101st Gallipoli landing anniversary. This is the first year for a considerable period of time that Easter has not fallen during Term 1 school holidays.... School holiday periods are often an anxious time for separated couples and their children. This holiday period, try to make it different. If there are court orders in place regarding the children's time with their mother or father, make sure the orders are followed. If there are no court orders in place, ensure the care arrangements are fair for both adults. Children enjoy spending peaceful time with both their parents and extended family. They are entitled to a conflicted free holiday with their family members. Parents should respect their children's rights to a smooth changeover at the commencement and conclusion of a holiday period. They should acknowledge the benefits to the children of a "stress free" or "no school" fun time. If the children are happy and relaxed the flow on effect to the separated parents is enormous.

08.01.2022 Parenting and property issues are dealt with by the Family Court of Australia and the Federal Circuit Court of Australia, under the Family Law Act, 1975. These Courts are Commonwealth Courts, not state courts and the Family Law Act is a Commonwealth Act, not a state Act. This means that the law relating to parenting and property disputes apply to all of us in Australia, no matter what State or territory we live in. The Family Law Act deals with parenting arrangements for chil...Continue reading

06.01.2022 Do you know where your children’s passports are? The case of Sally Faulkner and the botched ‘kidnapping’ of her children from the streets of Beruit is tragic in so many ways. It is tragic for Ms Faulkner, a mother who felt like she had no alternative than to attempt to snatch her children after (she alleges) they were removed from Australia by her ex without her consent. It is tragic she now faces a long prison sentence in Lebanon. It is equally as tragic for the children’s f...Continue reading

03.01.2022 Do you feel too busy and too stressed to fit exercise into your daily routine? Most of us consider raising the heart rate a chore but you do not need to be an athlete to discover the connection between exercise and stress relief. Stress is bound to occur at some stage in your life, most of us experience it every single day of the week. Generally speaking, it is not possible for us to rid the stress from our life but we can learn to manage it effectively. Some of us even str...ess out about the very thought of exercise. Fortunately scientists have found that regularly participating in some form of aerobic exercise will improve sleep, decrease tension, brighten your spirits and fuel anti-anxiety effects. You do not need to run a marathon to feel the effects that pumping some oxygen into the body can give you. There are many ways you can get moving to manage your stress. Take a yoga class, walk to work, clean the house, take the stairs, buy a step tracker and challenge yourself or get out of bed 30 minutes early and go for a stroll. Get your offspring involved and make it a family affair! Reduced stress levels could even improve your relationship with your partner and family members. Most of us tend to get frustrated and yell at our loved ones when we are feeling tense. Join a sporting team to get moving and you might even meet a new and improved partner to ease your woes. Physical activity will help you to clear the mind and give you a fresh approach to the challenges that may lie ahead of you. Do not get too excited. You must walk before you can run. Jumping into vigorous activity will only lead to injury which may stress you out even more than you were to begin with. Schedule your exercise and stick with it. If you want to use the I don’t have time excuse then my friend, you are sadly mistaken. Exercise in increments, park your car further away from your destination than you usually would, pass on the golf buggy, weed your own garden or mow your own lawn. Anything is better than nothing! You do not need to suffer the puffing alone, get a friend to join in on the endorphin pumping and have a gossip whilst you take a walk to your nearest park. If it’s raining take an umbrella, if it’s too sunny wear a hat, if you are afraid of being mugged equip yourself with a cricket bat. There is no excuse to sit on the couch eating potato chips. If you have two feet and a heartbeat take the pressure off the booty and get moving.
