23.01.2022 FLPA CALLS FOR BETTER LEGAL AID FUNDING MANAGEMENT In a media release today, FLPA welcomes the governments announcement to provide more funding to Legal Aid Queensland for cases to which section 102NA of the Family Law Act 1975 applies but calls for an improved system for managing and monitoring the funding. Following recent incidents where several trials needed to be adjourned in the Family Court of Australia and Federal Circuit Court of Australia in Queensland due to the ...shortfall of funding for Legal Aid Queensland to provide legal representation in section 102NA cases, the government has responded with providing more funding for this financial year. FLPA president James Steel said despite the additional funding, cases have already been adjourned and will now need to wait until the Courts have available time, in already busy lists, to hear the matters. FLPA welcomes the announcement for additional funding but believed the funding crisis occurred because there was no proper system to monitor the annual funding allocation following the introduction of section 102NA late last year, said Mr Steel. 12.01.2022 FLPA ENDORSES REASONABLE AND SENSIBLE APPROACH TO PARENTING ORDERS In a media release issued today, the Family Law Practitioners Association of Queensland (FLPA) supports the statement from the Family Court and Federal Circuit Court (the Courts) encouraging parents to take a reasonable and sensible approach to ensure they comply with existing parenting orders during the current pandemic, including over the Easter weekend. In the Chief Justices (the Honourable William Alster...gren) statement from the Courts, he clarifies what is expected of parents in these unprecedented times. FLPA president James Steel said family law practitioners were supportive of the statement that urges parents to do what they can to fulfil their existing parenting orders, keeping in mind what is in the best interests of their children. The Court has given family law practitioners as well as parents a clear directive on how parenting orders are affected by the COVID-19 virus, said Mr Steel. Parents should continue to comply with parenting orders and children should continue to spend time with each parent. There are going to be situations where this is not possible or not safe for the children, but we strongly discourage parents from using the current circumstances as an excuse to frustrate compliance with orders. The Courts statement makes clear if orders cannot be complied with that parents should communicate with each other to find a practical solution to these difficulties, Mr Steel said. Mr Steel encouraged parents who were unsure about their parenting orders and needed advice to contact their family lawyer, the Family Relationships Advice Line or Family Dispute Resolution Services.

Pictured here (appropriately socially distancing) with Executive Director of the College of Law Ann-Maree David and FLPA President James Steel, Tegan was excited to win the scholarship. Thank you to FLPA and the College of Law for providing this opportunity. It is truly a great scholarship for students looking to complete practical legal training, she said. Tegan already has a passion for family law, particularly within community legal centres. During her studies, she has worked as both a volunteer and a paid assistant with Women’s Legal Service which sparked her interest in helping those unable to afford paid legal advice or representation. FLPA President James Steel said they were very pleased with the high standard and the number of applications for this new scholarship. We are very excited about continuing this partnership with the College of Law and being able to provide this opportunity for the next generation of family lawyers, James said. The College of Law PLT course is the leading program in Australia for law graduates preparing for admission to practice and is worth almost $10,000.
