25.01.2022 Attention Commercial and Retail Tenants and Landlords: The Commercial Tenancy Relief Scheme was amended from 29 September 2020 and new Regulations now apply to any rent relief applications made between 29 September 2020 and 31 December 2020. It is important to note that any further application for rent relief under the new extending Regulations only applies from the date the Tenant makes an application to the Landlord that complies with all of the new Regulations' requiremen...ts. So, Tenants, if you need further rent relief, you need to apply to your Landlord sooner rather than later and make sure you meet all the requirements of the Regulations the first time when making your application! If you need help with rent relief negotiations, as a Tenant or a Landlord, we have recent experience in this area and would be happy to assist. www.fosterlegal.com.au

If you're an avid points collector, they can be worth quite a lot, so its important to consider what will happen if you're not there to use them and how to include this in your estate plan or will drafting. At this time, we are still working but the physical office is closed for all but essential appointments. Foster Legal Lawyers was established as a remote legal firm and can continue to operate this way. Online bookings are not currently available and we request that if you require an appointment, you call us on 0497 620... 188 to discuss your needs. We therefore request that if you need to attend our office and you are in any way unwell or have a fever that you reschedule your appointment. We have families that we also need to protect. Given this is a continually developing situation, our position may change at short notice but we will keep our clients informed on an ongoing basis. We thank you for your understanding and wish you all well.

19.01.2022 For those of you with discretionary trusts, including family trusts, it is time to review your Trust Deeds. From 1st March 2020, the State Revenue Office will ...consider any discretionary trust that has a "potential foreign beneficiary" to be a foreign trust and therefore any land purchase by that trust will incur an additional foreign purchaser stamp duty levy of 8% of the purchase price. In short, this means that ANY discretionary trust which does not contain a clause specifically excluding foreign beneficiaries will be considered a foreign trust purchaser by default. If you are unsure of your position with regard to these rulings, contact Foster Legal and we can help you review your Deeds to ensure they meet your needs and comply with legal requirements. https://www.sro.vic.gov.au/foreign-purchaser-additional-dut

10.01.2022 Just a quick update on what we announced today for renters and landlords: We've extended the ban on evictions and rental increases until the end of the year s...o if you fall behind or you're doing it tough because of coronavirus, you can't be evicted. And we've boosted new residential Rental Relief Grants up to $3,000 for tenants and landlords too if you've already received a $2,000 grant, you could be eligible for an additional $1,000. Land tax relief has doubled to 50% for eligible landlords, and a new $60 million relief fund has been established for small commercial landlords struggling to cover their costs. We're making things fairer for small business owners too, and rent reductions will now be based on the financial situation of each business. And the Small Business Commissioner now has new powers to enforce rent reductions where an agreement can't be reached. We don't want people worrying about the roof over their head or stressing over the rent right now. And these changes give Victorians a bit of extra security while we fight this pandemic.

07.01.2022 Commercial tenants please be aware, if you need to renegotiate lease terms or rent with your Landlord because of the negative impacts of COVID-19 on your business, you need to be eligible for AND registered to receive the Jobkeeper payments.
