25.01.2022 Sexual assault and child abuse are abhorrent crimes that have devastating impacts on survivors. Abuse in institutions that are trusted with the care of children is particularly appalling. A new Bill in the NSW Parliament will make it possible for victims to make fresh claims where they may have claims already settled but were treated unfairly.... We support this Bill so that child abuse survivors can at least see adequate and rightful compensation. Foye Legal manages institutional abuse claims with empathy, compassion, and a belief that the law should protect the vulnerable and legal redress can be part of healing and recovery. We strive to protect dignity, knowing that seeking a claim can reopen trauma. A sexual abuse case can be complicated, and we are committed to being part of the fight for justice. 23.01.2022 Fear of what will happen to beloved pets can sometimes stop a person leaving a violent relationship. And threats against pets can be used as a form of intimidation and coercive control. We’re pleased to see a bill being introduced to the NSW Parliament this week that would reform Apprehended Domestic Violence Orders to include better protections for pets. ... Amending AVOs to indicate explicitly that harm to, or harm threatened to, animals is a form of intimidation is an important step in responding to this vile form of abuse that seeks to terrorise victims and their much-loved animals.

23.01.2022 This really speaks to me. A quote from Entrepreneur Cindy Gallop about building a business: "There is a formula for success in business, and it goes like this: You set out to find the very best talent in the marketplace, and then give them a compelling and inspirational vision of what you want them to achieve for you and the company. "Then you empower them to achieve those goals using their own skills and talents in any way they choose. If, at the same time, you demonstrate... how enormously you value them, not just through compensation, but also verbally, every single day, and if you enable that talent to share in the profit that they help create for you, you’ll be successful. "It’s so simple, and virtually nobody does it, because it requires a high-trust working environment, and most business environments are low-trust. In order to own the future of your business, you have to design it around trust. Foye Legal was built on values that put people - clients, staff, their families, our community at the forefront of what we do, and it has been a major contributor to our growth and success.

23.01.2022 A person does not have to have bruises or other physical harm to be a victim of domestic violence. Monitoring a partner’s movements, cutting off money, isolating them form family or friends, killing a pet; these are all forms of coercive control designed to exert power over the victim through fear and intimidation. Too often, cases that end in an act of violence are preceded by a pattern of sustained coercive and psychologically controlling behaviour. ... The evidence is clear: of the 78 domestic violence murders between 2017 and 2019, 77 involved perpetrators using coercive control on their partner before killing them. I welcome efforts to by Anna Watson MP - Member for Shellharbour to put legislation to the NSW Parliament next week that would criminalise coercive behaviour and put perpetrators behind bars for up 10 years. These laws would offer victims protection before violence escalates and educate the community about acceptable behaviour in healthy relationships. - Diana

20.01.2022 What is mediation? A time-out for arguing ex-partners? For couples going through a separation, fighting out property matters and parenting orders in Court need not be how it ends. Mediation allows both parties to agree on a solution that works for everyone, particularly the children. Provided you’re both willing to end the blame game and focus on getting on with your lives. ... Mediation is a compulsory step before applying to Court for parenting orders, but if both parties are willing to give it a genuine go, doing it earlier could save you time, money, and stress. 19.01.2022 Through family dispute resolution, you get the chance to be heard and talk freely about how you’d like to resolve a disagreement with your ex over property, money, or parenting arrangements. You can avoid going to court, and potentially reduce conflict, which means less stress or trauma, as well as saving time and money on having your matter dragged through the courts. Ultimately, it means you both have a say in your future, and what’s best for your children. ... Senior Associate Lawyer Roberta Allen is now also an accredited Family Dispute Resolution Practitioner. 19.01.2022 At the 11th hour of the 11th day of the 11th month, we pause to remember those who died or suffered for Australia's cause in all wars and armed conflicts. Remembrance Day holds special significance for Foye Legal. We understand that the battles continue long after the conflicts have ended. This year, we think of those who can’t gather due to the pandemic and pay tribute to them with a minute’s silence to remember not only those lost, but all who came home and also those who f...ollow in their footsteps. Lest we forget.

18.01.2022 The systemic deficiencies in the NSW workers compensation scheme revealed in the ABC Four Corners program were shocking, and will hopefully be a catalyst for much-needed change. 18.01.2022 True or false? The starting point for property settlements in family law matters is always a 50-50 split. False ... Several factors are involved, starting with: Determining the values of the assets and property is not just real estate. Too often it is a precursor to horrific domestic violence and intimate partner homicide. This abhorrent form of abuse needs to be stopped.

03.01.2022 FOYE LEGAL’S WIN FOR INJURED WORKERS Injured workers who lost weekly compensation payments after five years are entitled to backpay after a win in the New South Wales Court of Appeal today. Changes to section 39 of the Workers Compensation Act 1987 (NSW) meant that unless a worker was assessed to have more than 20% permanent impairment, their payments would cease after 5 years.... Unfortunately, some injured workers have been unable to obtain the assessment until after their weekly payments have ceased and have therefore been subject to a period of time without financial assistance. Foye Legal successfully argued that an injured worker is entitled to have their weekly payments backdated for that period, if that worker has no, or a reduced, work capacity. Workers with serious and long-standing injuries do not deserve to have the added emotional stress and financial hardship simply because of the time it takes to get the required specialist medical report. 03.01.2022 The role of the Courts, legal services, and relationship counselling has been critical during COVID-19. We’re pleased to hear the Commonwealth Government has announced $220 million in the 2020-21 budget for family and child support programs, family law and family relationship services, and additional funding for Family and Federal Circuit Courts. These are vital services in keeping people safe, particularly children, yet are overloaded and stretched beyond capacity. ... Families should not have to wait years for a hearing, and children should not have to grow up in the court system. Let’s hope this money goes some way to relieving the pressure on the system and ensuring access to justice for the most vulnerable. - Diana

02.01.2022 Being injured on the road or at work can be traumatic enough without the added stress of dealing with government bureaucracy. Any compensation claim should be dealt with justly and quickly to help people put their lives back together. Unfortunately, many claims get bogged down in dispute resolution.... Foye Legal welcomes news that the NSW Government has merged the dispute resolution systems of the workers compensation and CTP insurance schemes into a single, independent tribunal the Personal Injury Commission (PIC). The one-stop-shop should put the injured person at the centre of the dispute resolution process, and have it dealt with by an independent tribunal rather than government bureaucrats. Foye Legal has always strived to reduce the emotional and financial hardship our clients and their families face when going through life-changing events. 01.01.2022 We keep hearing about how getting through COVID-19 is a community effort. That we’re all in this together. Yet, the Disability Royal Commission this week heard that there was a major delay in a Federal Government-led emergency response plan for the disability sector. In April, a group of some 70 disability organisations issued an open letter imploring the Government to address pandemic measures specifically for the disability sector.... Royal Commission Chair, Ronald Sackville QC, said: "In one sense we are all in this together but we have not all been affected equally." Sobering words. A reminder that if we’re all this together, we need to start with protecting and supporting our most vulnerable.
