The race to Mornington was fun Started with no wind and we struggled to get across the starting line Then got caught up in a log jam of boats see videos on Facebook Thanks Sonia! 22.01.2022 Today is the 5th anniversary of my brother Guy's workplace death We have received a letter from WorkSafe Tasmania (copied below) which helps with bringing some ...finality to a long drawn out process of understanding what went wrong Hopefully workplace safety will become an issue of greater focus in the Apple Isle 20 October 2020 Mr Dennis Clark Dear Dennis WorkSafe Tasmania Investigation into the Death of Guy Clark Thank you for contacting WorkSafe Tasmania about your family’s concerns regarding the WorkSafe Tasmania investigation into Guy’s death. I appreciate the time taken by the family to discuss their views in our videoconferences. The family expressed concerns that our investigation gave the impression that Guy’s death was attributable to his own actions and that WorkSafe Tasmania appeared to be not cooperating with the coronial inquest. Additionally, there were specific concerns about: the investigation not obtaining evidence from electrical repairers or thoroughly investigating the electrical faults; the failure of the business to provide training and information not resulting in prosecution; and the status of the Coroner’s recommendation for residual currency devices (RCDs) to be installed in all workplaces, regardless of when the workplace was constructed. WorkSafe Tasmania actively seeks to improve our investigations and values the feedback that the family has provided us. I want to assure you that WorkSafe Tasmania was not intentionally failing to cooperate with the Coroner’s orders. During the coronial inquest, we recognised that we should have disclosed all materials in our investigation file, regardless of whether we believed they were subject to client legal privilege. Our submissions stated that we have put in place procedures to ensure this does not occur in future, and we apologised to the Court, to the family and parties to the inquest. I want to re-iterate our apologies to you, particularly with our deeper understanding of the distress that this failure caused the family. We have followed up the concerns about the perceived gaps in the investigation of the electrical faults and have provided you with advice on these matters from Mr Henry Hodgson, Manager Electrical Standards and Safety in Consumer, Building and Occupational Services, Department of Justice. WorkSafe Tasmania relies on the expertise of this specialist unit in the investigation of electrical incidents. Mr Hodgson also provided advice on the status of the Electrical Safety Bill which is being considered in Parliament. In relation to the failure of the business to provide training and information that was commented on in the Coroner’s findings, I have decided to refer the WorkSafe Tasmania investigation file to the Director of Public Prosecutions (DPP) for review and a decision on whether there were failures in the duties owed by Pyengana Trading Company Pty Ltd to Guy that warrant prosecution. Since Guy’s death, WorkSafe Tasmania has implemented a new procedure that all workplace fatality investigation files are referred to the DPP for review to ensure prosecutable failures are identified and charges laid if warranted. WorkSafe Tasmania has identified that our investigation could have more clearly identified the evidence relied on by the investigating inspector to form a reasonable belief that he was unable to find any breach of the Work Health and Safety Act 2012 or Work Health and Safety Regulations 2012. Since this investigation was completed, we have issued guides to better support inspectors when undertaking investigations. We have also invested in an information technology solution that will provide clearer and more consistent investigation outcomes and is being supported by an increased investment in inspector training. Finally, we have identified that we need to make sure the families of deceased workers are better supported while we are undertaking our investigations. We are currently looking at the options for how this support may be provided. Please pass on my sincere condolences to your family for the loss of Guy, especially on this anniversary of his death. Please also extend my thanks to the family for their feedback on our investigations, and I once more extend my apologies for the additional concerns caused to the family by our investigation. No word yet from RYCV but RBYC and SYC have been broadcasting their racing starting from today 28 October However the 25k travel limit still applies until 8 November on current indications and Williamstown is beyond my limit Not sure how a composite crew and 25k from home for each could be calculated anyway ... So I expect that our first race will be on 14 November actual race to be confirmed once RYCV, HBYC and RMYS release their race schedules I prefer longer distance races to windward/leewards Based upon current guidelines my boat length (34 38 foot) dictates 5 crew X&Y being 36 foot We could be cute and add the bowsprit length which would take us to 6 crew (38 41 foot) Crew list nominations now open!
