24.01.2022 WOODSIDE HAS BEEN SERVED! We're heading to the Supreme Court of WA over Australia’s largest fossil fuel project, Woodside Energy’s massive Burrup ...Hub gas project. On behalf of the Conservation Council of WA, we’ll be arguing the WA State Government unlawfully approved changes to plans for two Burrup Hub gas facilities. Woodside changed the scope of these projects after they were initially approved, and our client says the impact of those changes hasn’t been properly assessed, even though it would lead to billions of extra tonnes of carbon pollution. This Supreme Court case is about ensuring the climate impacts of each aspect of the Burrup Hub proposal are properly assessed, every step of the way.

24.01.2022 Full text of this story: BHP has rejected a proposed moratorium on mining activities that might impact cultural heritage sites across Australia until relevant l...aws are strengthened. Activist shareholder group, the Australasian Centre for Corporate Responsibility, has called on BHP to adopt the moratorium as well as allow Indigenous groups to speak publicly on heritage concerns and for the company to disclose its lobbying expectations on the issue by its industry organisations. BHP has recommended shareholders oppose the motion, which will be put to its annual meeting next month. The mining giant argues a unilateral moratorium would have the unintended consequence of disempowering Traditional Owners to manage their cultural heritage, which it argued was inconsistent with the principle of self-determination. Current agreements would be put to one side without consultation with Traditional Owners, it said. BHP said adopting the moratorium would amount to an indefinite suspension across all Australian jurisdictions, not just WA. It noted its mutual agreements with Traditional Owners did not restrict them from speaking publicly on heritage concerns. It also argued submissions by the Minerals Council of Australia and the WA Chamber of Minerals and Energy to a Federal Parliamentary inquiry into the issue had supported improvements to cultural heritage laws. Shareholder concerns over Indigenous heritage sites have been piqued in recent months by Rio Tintos destruction of ancient rock shelters in the Pilbara. The WA Government is rewriting the Aboriginal Heritage Act to strengthen the protection of sites.

20.01.2022 Sacred sites (Tui Claypans) drilled with impunity in the Northern Goldfields as mining company fails to deal with traditional owners and registered native title... claim. Waturta Country is under threat from over zealous mining companies emboldened by State Government ACMC and EPA decisions, including a Section 18 approval for damage to significant sacred site Marlutja (Lake Wells). Despite fallout from Rio Tinto destroying Juukan Gorge we still have miners and government ignoring calls for a moratorium on exercising thier legal rights to destroy Aboriginal sites. Waturta people are appalled that days after learning of the EPA approvals to damage thier significant sites, informed by ACMC recommendations, we find evidence of a related mining company showing complete disdain and disregard for our sacred places by drilling these holes with no communication to us whatsoever. I urge anyone and everyone in WA with a... deep concern for the safety of Indigenous Cultural Heritage to write in a submission and have their voices heard. They need as many different voices as possible to create the strongest possible foundation for crafting a law that will positively impact all West Australian heritage for decades. Our First Nations people have been let down time and time again with the outdated and ineffective Aboriginal Heritage Act of 1972 that allows for wholesale destruction of precious sites like we saw at Juukan Gorge just a few months ago. We cannot allow it to continue. This is one of the most important pieces of legislation WA may ever see before it for our First Nations brothers and sisters. 14.01.2022 Colin Barnett is correct: there does need to be a Royal Commission into Rio's Juukan Gorge site destruction and the contempt for Aboriginal people's cultural heritage sites which has been showed for too long in WA. As reported by The Australian on Monday, Gavin Fielding, the Chair of the Aboriginal Cultural Materials Committee which approved Rio's section 18 destruction of the site held shares in Rio, yet did not recuse himself from the ACMC decision. It now appears that despite Fielding's legal expertise as a former member of the Industrial Relations Commission, the ACMC meeting which approved Rio's application was inquorate, which could mean that the Juukan Gorge decision was potentially legally invalid. #justanotherdayinwa

07.01.2022 You may have seen in the media today that the former Premier Colin Barnett is calling for a Royal Commission into the destruction of Juukan Gorge. Whilst I ful...ly support such a motion it needs to be made clear that what happened at Juukan Gorge was symptomatic the much larger issue of how Indigenous Heritage is handled in WA. To understand how Rio Tinto and the State Government of the day failed our First Nations communities we need to look at the mechanisms that still exist today which allow companies to destroy Indigenous Heritage anywhere in the state. A Royal Commission would give a far broader scope to the issues plaguing Aboriginal Heritage in the state and complement the current inquiry into specifically Rio Tinto's role at Juukan. This would be a vital investigation that would lead to a greater understanding of the importance of strong Heritage laws and ideally, the creation of a far better system under the newly proposed Aboriginal Cultural Heritage Bill. "The decision maker is not an independent arbiter, it's the state of Western Australia which has an economic interest in mining in this state," Mr McIntyre said. "I would have thought that where it couldn't be agreed between those interested parties, you might have something like the State Administrative Tribunal being an independent arbiter as to the correctness of the decision."
