19.01.2022 Loosing a hearing isnt the best feeling however it may be to your client's advantage as we learned on Friday. Our solicitor appeared at a contested hearing at the Local Court to defend assault and stalk/intimidate charges. Although our client was convicted, the actual facts of the case were determined in an open court through careful cross examination and the Magistrate took this into account in sentencing. 17.01.2022 Bail Act 2013 (NSW) - Multiple release applications s.74 of the Act. Successful in overcoming this hurdle today. Important lesson - seek legal advice before applying for bail. Whilst it may seem to the defendant that bail should be applied for instantly, careful thought and preparation is needed to ensure the relevant material is placed before the Court to enable an informed decision. Any appeal of the decision may leave you waiting a while before you are given another opportunity at the Supreme Court. Feel free to call our office if you have a bail application.

16.01.2022 Pleading guilty to an offence, despite the fact that you are innocent, with the view to getting a section 10 (non conviction) can have its pitfalls. Never plead guilty if you are innocent. Perfect example where a taxi driver plead guilty despite the fact that he was innocent, was able to get a section 10, still lead to him losing his licence. 05.01.2022 The Family Court has power under Pt VIIIAA of the Family Law Act to make orders binding 3rd parties including companies and trusts. Such order will override anything in a trust deed or other document. Do not underestimate the powers vested in the Family Court dealing with children and property disputes.
