If you dont wear a tie every day, there is no real need to wear your wedding suit to this event. There is a good reason for this. * The duty list for the courts is displayed in the lobby of the court, on which your name and court number will be identified. Knowing this will make the day easier and less stressful! * Whe...n any Judge or Magistrate enters or leaves the courtroom, you should stand. You will note that all lawyers bow their heads when entering and exiting the courtroom - this is a very old tradition and mark of respect. * You should stand when you are speaking to or being spoken to and address the Judge or Magistrate as Your Honour, but there is no strict requirement as long as you are polite the Judge or Magistrate will usually not mind if you forget this. and Above all, if you have any questions, you should ask a lawyer for advice! Dont let them down." And this is a very good reason as to why entrusting the biggest purchase in your to the cheapest offering might be a bad idea; proper planning and preparation is key.
23.01.2022 Despite the rather surreal nature of the crime, it does seem more and more common in the era of social media for the unscrupulous to attempt to take advantage of ex-lovers and partners through extorting them for payment or gifts. People should really be made more aware that this is actually a criminal offence and one that we deal with quite often.

18.01.2022 The recent Aluminium Composite Panel fires in Spencer Street Melbourne is another example of a very concerning topic for the building industry. The building is just around the corner from our King Street offices. Why it is such a concern is because it goes beyond what we assume are faults in the building industry - it goes to insurance, product liability and government regulation. In our opinion, the causes are multifaceted and it is not enough to take an easy route of bla...ming shoddy builders or greedy developers: they were clearly using a product that complied with all regulations at the time. Our vision of things in hindsight is always 20/20. The complicating human factor is that where deaths have occurred in these fires, part of the cause of the damage and terrible loss of life has been the lack of fire regulation and maintenance in those buildings - fire escapes blocked off with flammable furniture, fire alarms deactivated and overcrowding. Then there is the issue that both the recent fires in Melbourne have a human cause; cigarettes. Personal responsibility needs to play a part at some point.

In the current Covid-19 global pandemic, the normal rules and conduct of business have changed, and some things are a crisis and some things are not. Statutory Demands and limits regarding insolvency (including trading while insolvent) have been summarily amended; national and state politic...ians have issued statements on how legal terms are to be treated by the Courts, Landlords, Creditors or Debtors. It is a crazy new world, but it pays to be prepared. The important aspect for our clients is to be well-informed and connected to sources of information and market leaders in the financial, retail, property and building sectors; if you have to take a gamble, it is not just the legal aspects, but to be as commercially well-informed as possible. Developers and builders should have greater respect for their products and their duty of care to us all.
12.01.2022 "...motivated by greed and "plain old maliciousness" - We have seen many examples of this sort of crime come through the justice system and the greatest betrayal always has to be against the real victims - but the best summation comes from the prosecutors who said: "This was a crime committed not just against one family. It was committed against the community and against real victims of assault and domestic violence. Fake allegations are a waste of valuable police time and resources"

It also illustrates why having a thorough review of your contracts and section 32; followed by a building inspection are essential and best practice for purchasers. Our reviews are free, the inspections are about $700 each; but if you are going to bite the bullet for >half a million in debt, it is a absolute no-brainer.

06.01.2022 The biggest problem for our clients in common industries is a lack of trust and proper documentation about what is going to be done, and how someone is going to get paid. Often good people are eager to do a good job in the reasonable expectation that they will get paid. Far too often however, there are plenty of less than honourable people willing to take advantage of others for their own gain - we often deal with cases where a Debtor is an experienced and serial non-payer; only ever paying once they are threatened with legal proceedings or sanction.

04.01.2022 Conveyancing and listening; sometimes the most obvious question that should be asked is what a client wants TO DO with a property. Recently we have heard of a situation in which a purchaser bought a property assuming that they could turn a shopfront into a salon. Even though they might have a claim against the conveyancer, because the conveyancer has no assets or insurance, they are facing an uphill and risky Court fight to sort out the problem. 03.01.2022 There are REAL risks in conveyancing and property law - but the fault lies in the way in which the conveyancer handles their files and instructions. Letting your IT systems get hacked does not mean that the system is flawed - it just reiterates the hard lesson that the world can be a dangerous place and we all have to be ever mindful of the risks.
03.01.2022 Why are (written) Loan Agreements are so essential? We do get some enquiries from new clients wanting to lodge a caveat for a debt or claim against a debtor. A caveat is a serious document that can only be used in certain circumstances, and best evidenced by certain clauses in a loan agreement. A recent case in the NSW Supreme Court illustrates exactly why we do so many loan agreements for clients - for anything from friendly loans to family and business partners. The reaso...n is that there must always be a proper basis for lodging a Caveat and it should be in writing. In the recent judgement of Justice Kunc in Guirgis v JEA Development P/L. [2019] NSWSC 164, a conveyancer lodged a caveat on title on express instructions from an ex-wife, over property held by her ex-husbands company. She reassured the conveyancer into registering a caveat and lied about there being a loan agreement. The upshot of all of it was that the Court awarded costs against the ex-wife and the conveyancer. Justice Kunc stated The legislative and regulatory scheme which I have set out above assumes that the person making the various representations and certifications in an electronically lodged caveat has the requisite degree of knowledge and has approached their task with appropriate diligence. Accordingly, it is ESSENTIAL throughout Australian jurisdictions determining that a caveat lodged without proper foundation may result in costs and damages orders against not only a caveator, and significantly also against unwary conveyancers and legal practitioners.
