25.01.2022 Congratulations to solicitor, Cameron McKenzie on his appointment to the Southport Magistrates Court. It is pleasing to see the appointment of a solicitor to the Bench. Mr McKenzie is currently the Deputy Chair of QLSs Domestic and Family Violence Law committee. His experience in this area will be well received at Southport. Congratulations also to long-time Legal Aid solicitor Rosemary Gilbert and Acting Magistrate Robert Walker on their respective appointments.

24.01.2022 Under changes passed during regional parliament in Townsville on 4 September, the Queensland alcohol interlock program, which requires sentenced drink drivers to unlock their cars by passing a breath test on a device installed in their vehicle, will be expanded to apply to mid-range drink drivers. Other changes include requiring all drink driving offenders to complete an education intervention program before they can reapply for their driver licence. The new laws will compel... all first-time offenders to complete an online Brief Intervention Education Program before they can drive again. There can be no justification for bans fide journalists being the subject of search warrants and possible criminal sanctions for reporting on the government. National security threats can not be allowed to change the fabric of Australia's freedom of the press.

22.01.2022 From 1 February 2020, bicycle riders who use their phones illegally, while riding will receive a $1,000 fine. It is illegal to use your phone in your hand while riding or stopped at the traffic lights.



21.01.2022 On 29 January 2020, under the Public Health Act 2005, the Minister for Health and Minister for Ambulance Services made an order declaring a public health emergency in relation to coronavirus disease (COVID-19). Its duration has been extended by regulation to 19 May 2020 and may be further extended. The Direction requires all Queenslanders to stay in their homes other than in limited circumstances. A person to whom the direction applies commits an offence if the person fails, without reasonable excuse, to comply with the direction.

18.01.2022 Queensland Police have announced that they will send alerts and emails to drivers who fail to pay for petrol. Section 408C(h) of the criminal code makes it an offence punishable by up to 5 years imprisonment, to intentionally drive off without payment. Police are to be congratulated on this initiative, which will avoid unnecessary investigation where a person has simply forgotten to pay. 17.01.2022 Jon Wagner, retiring head of the Drug and Serious Crime Group, calls for minor possession charges to be diverted to educational programs. Currently the police have to process minor drug matters (other than cannabis), through the Court system. The Qld government needs to urgently bring Queensland in line with other states and offer education and other diversionary programs.

12.01.2022 From 31 January 2020, provided you are over 18, youll be allowed to possess up to 50 grams of cannabis and grow two plants for your personal use in the ACT. There will be a maximum of four plants allowed at one residence. It will remain unlawful to drive with cannabis in your system and you will be prohibited from sharing (supplying) your cannabis. Bizarrely, it will remain an offence to purchase seeds. Given the difficulties Qld has had with medicinal cannabis we cant see similar laws here any time soon.

11.01.2022 Australias toughest mobile phone laws come into effect today. Using a mobile phone while you are moving or stationary (but not parked) will incur a $1,000.00 fine and 4 demerit points. Be aware that using a mobile phone includes turning the phone on or off, or using any function such as Spotify. 08.01.2022 The ACT Chief Minister, Chris Steele, has introduced the Animal Welfare Legislation Amendment Bill 2019. The ACT is now the first jurisdiction to recognise pets as sentient beings after tough new animal welfare laws were passed. The laws, which come into affect in six months, recognise that animals deserve to have a quality of life. It introduces tough new penalties for mistreatment of animals with owners facing up to $4000 in fines for dogs that have been confined for a full day, and then not exercise within the next two hours. The laws will also impose a $4000 penalty where pets are not provided with appropriate food, water, shelter or a clean and hygienic environment. People taking part in violent animal activities, such as dog fighting, could be find up to $48,000 and face three years imprisonment.

06.01.2022 Congratulations to new Deputy Chief Magistrate, and former Southport Magistrate, Janelle Brassington. Her Honour is in good company with, both the current and former Chief Magistrate having spent time at Southport Magistrates Court. Perhaps its the quality of advocacy at Queenslands second busiest Court that sees Magistrates from the Gold Coast elevated.

05.01.2022 Queenlsand police say that they are stepping up enforcement measures for people disregarding quarantine directions and flouting isolation laws. The Coronavirus is defined as a notifiable condition within Schedule 1 of the Public Health Regulation 2018. Amendments to the Health Act on 19 March 2020, gave additional powers to the police and health officials to give quarantine directions. If a person does not comply with the quarantine directions, penalties of up to $13,345.00 for individuals and $66,672.50 for corporations may apply. We are all in this together, lets make sure we rid the country of COVID-19. A two week quarantine might save a life.

Sadly they will replace Judges McGuiness and Muir maintaining the status quo of three permanent Judges at Southport. It seems that significant trials will still be transferred to Brisbane for hearing due to a lack of capacity at Southport.
