18.01.2022 LATEST UPDATES ATO data matching motor vehicles The ATO will acquire information for the 2016-17, 2017-18 and 2018-19 financial years on vehicles that have been transferred or newly registered where the purchase price or market value is equal to or greater than $10,000. Data will be acquired from the eight state and territory motor vehicle registry authorities.... It is estimated that records of 1.5 million individuals in each year will be electronically matched with ATO data holdings to identify non-compliance with obligations under tax and superannuation laws. The Gazette notice for the data matching program (Gazette C2018G00277, 13 April 2018) notes the objectives include: obtaining intelligence about taxpayers buying and selling motor vehicles to identify risks and trends of non-compliance with tax and super obligations identifying and addressing taxpayers buying and selling vehicles who may not be meeting their obligations to register and lodge returns (including activity statements) and ensure the correct reporting of income and entitlement to deductions and input tax credits identifying taxpayers of interest for investigation, such as sellers, licenced dealers, fleet managers, leasing companies, or representatives of these taxpayers to determine if interposed proxy ownership is used to conceal the real accumulation of wealth identifying taxpayers who have not met obligations regarding GST, fringe benefits tax, luxury car tax, fuel schemes and income tax.

09.01.2022 Undoubtedly the headline item from the May Federal Budget is tax relief for individuals by lifting the 32.5% tax bracket to $90,000 from 1 July 2018 and the Governments announcement of its intention abolish the 37% tax bracket in 2024-25. In the 2022-23 financial year we will also see the Low Income Tax Offset increased to $645 and the 19% tax rate from $37,000 to $41,000. 05.01.2022 Court tosses out tax dodging argument after a taxpayer tries to waive rights as a person. The Bendigo Magistrates Court has convicted and fined a man $6,000 for failing to lodge six tax returns because he does not consider himself a person. The man, of North Bendigo, told the court that he did not accept the six charges of failing to lodge an income tax return because he was a human being who waives my right to recognition as a person, as first reported in The Bendigo Adver...tiser. The man had failed to submit six tax returns for the financial years ending 2012 to 2017. The ATO had repeatedly contacted him on his obligations to file his tax returns on the basis that he was earning income. A final notice to lodge the six tax returns by January 18, 2018 was sent to him on November 30, 2017. In his defence, the man referred to the Universal Declaration of Human Rights and the Universal Covenant on Civil and Political Rights to waive his right to personhood. "As I waive my right to recognition as a person, I am not a resident for tax purposes," he said. Instead, magistrate Michael King found the man guilty of all six charges, noting that paying tax did not contravene human rights, and rubbishing the mans arguments as entirely lacking in merit. The man was convicted and fined $6000 plus costs, and ordered to lodge outstanding tax returns by 1 May. "That would make a mockery of the law," said Dr King "This was persistent and blatant disregard of income tax law.
