24.01.2022 Beneficial news for Hong Kong passport holders effective from 21 Aug 2020: The new migration Legislative Instrument Migration Amendment (Hong Kong Passport Holders) Regulations 2020 amends the Migration Regulations to extend validity of temporary work (subclass 457/482 Temp Skill Shortage visas) and temporary graduate visas (subclass 485) for a 5-year period from 9th July 2020 to 8th July 2025 if the primary visa holder held a HONG KONG SPECIAL ADMINISTRATIVE REGION OF THE ...PEOPLE’S REPUBLIC OF CHINA passport when the visa was granted and still valid on or after 9 July 2020. Secondary family members will also be granted the same visa irrespective of the passport they hold. Visa Subclass 482 TSS (Temporary Skill Shortage) and Visa subclass 485 (Temporary Graduate) visas granted from 9th July onwards will be provided with a 5-year validity. Permanent residency pathways for these visa holders will be announced later. 22.01.2022 As of 10 Sep 2020: all holders of the subclass 188 Business visa will no longer need to apply for travel ban exemption to Australia. This is the only temporary visa at present that is auto-exempt from travel bans (apart from members of family unit of an Australian PR or citizen or NZ citizens usually resident in Australia). https://covid19.homeaffairs.gov.au/travel-restrictions#toc-2 If you hold this visa in the Business Innovation stream (188A) and have been stuck abroad since Covid 19 travel bans, now is your chance to return to Australia to either continue or start your business operations. Likewise if you are holding this visa for other 188 streams, you can now return to Australia.

16.01.2022 Notice about the 491 - SBO (Small Business Owners) Program From 1 April 2021 - the pre-existing business purchased will need to have been in operation for 2 ye...ars instead of 1 year. There will also need to be a minimum purchase price of $100,000 (rather than total investment in the business). Furthermore, sub-leases of franchises (such as petrol stations), and home-based businesses (such as courier and cleaning businesses) will not be considered. These requirements are aimed at ensuring the program is sustainable in the long-term. Please note: businesses that have been purchased prior to 1 April 2021 are not subject to these requirements. however there must be a valid contract provided for the business before this date (i.e. business must have settled).
