12.01.2022 FACTUAL FRIDAY Coffs/Clarence Police have received numerous complaints from members of the public in relation to unregistered / uninsured trail bikes riding in ...the Boambee East, Toormina & Sawtell areas. The trail bikes are riding on public roads, through reserves, and also in National Parks and Wildlife areas. These are road / road related areas as defined under the Road Transport Act. The associated infringements have substantial financial penalties: Motor Accidents Compensation Act 1999 Compulsory insurance - Use uninsured motor vehicle $697.00 Motor Vehicles Taxation Act 1988 Unregistered vehicles and vehicles upon which tax has not been paid - Owner use vehicle on road/road related area with tax unpaid $697.00 Owner permit vehicle to be driven/used with tax unpaid $697.00 There is a risk to members of the public utilising these areas lawfully (including other motor vehicles). Consider your actions if you are involved in a motor vehicle accident and injured another person. Their insurance company and the magistrate certainly will. Highway Patrol officer’s are targeting these offences and when you are caught expect to have your trail bike seized if it is not registered / insured and/or your manner of riding in deemed dangerous. Road Transport Act 2013 No 18 79 Power to seize unregistered vehicles (1) A police officer may seize any unregistered registrable vehicle (other than a registrable vehicle exempted from registration under this Act) that is being used on a road. (2) If any such registrable vehicle has been seized, the Local Court may, on the application of a police officer, make an order declaring the vehicle to be forfeited to the Crown. See more
