21.01.2022 Home buyers fall foul of finance clause MARISSA CALLIGEROS May 14, 2013 BRISBANE TIMES. A Queensland woman has been ordered to pay more than $10,000 to unit owners after wrongly relying on the "subject to finance" clause in a sale contract as a "get out of jail free card".... Anne Marie Miller* agreed to buy a Port Douglas unit for $575,000 in September 2010 on the condition she secured a loan for $400,000 from ING Bank within seven days. Under standard sale contracts buyers must take "all reasonable steps to obtain finance". However, the woman's mortgage broker never submitted a formal application to ING Bank. Instead, the broker made an application to The Rock Building Society. The building society could not approve the loan application by the nominated date and Ms Miller terminated the contract. Not satisfied, unit owners Trevor and Irene Hauff demanded to see evidence that Ms Miller made a sufficient effort to obtain a loan from ING Bank, as stipulated in the contract. The Hauffs took their case to the Supreme Court, which ruled in their favour. Ms Miller appealed the decision in March this year but lost. Associate Professor Kristy Richardson of Central Queensland University's property programs said Ms Miller's experience served as a cautionary tale. "The realisation that you might not be able to afford the great Australian dream may turn into a contractual nightmare," she said. Ms Richardson said the subject to finance clause could not be taken lightly or used as a "get out of jail free card". "Under a contract of sale, you as a buyer will be required to take all reasonable steps to obtain the finance that you are saying that you will under the contract," she said. "Also bear in mind that documents supporting your attempts to obtain finance can be called upon." Ms Miler was ordered to pay the Hauffs her $13,000 deposit for breaching the sale contract. *Correction: Ms Miller was the buyer, not the Hauffs as previously reported.

20.01.2022 March 29th 2012. Re: Mr Gerry Manning To Whom lt May Concern Recently my husband and I had to sell our deceased Uncles' house which was situated in the Campbelltown area. Having no experience in selling property and... dealing with Land Agents, we asked around and Gerry was recommended as an honest and reliable Land Agent who would help us through the process. From the first meeting with Gerry at our Uncles home, he impressed us with his honesty, friendliness and professionalism. He showed us a portfolio he had put together outlining other properties in the area that were up for sale and the price range and number of days/weeks that they had been on the market. He also went through all expenses that we would incur as the sellers, so we knew exactly what was going on. He went through the house with us and helped by giving us advice on how to freshen it up. We took his advice and were very pleased with the painter that Gerry had recommended. The end result was amazing and we could see we had been given sound advice. We naturally assumed there would be countless open inspections and it would take time to sell. However, Gerry recommended we take the property to an "in-house" auction which was being held at the Arkaba Function Room. He explained the whole procedure of auction including the financials, very clearly so that we understood what would be happening. He conducted a number of open inspections prior to the auction and rang us after each one just to let us know how many people went through the house and what the general feeling from prospective buyers was. We found these phone calls from Gerry very informative and gave us hope that things were looking good. The auction was a success and the house was sold. Throughout the proceedings Gerry once again kept us informed as to what was happening and just how many bidders were present. We were thankful we took his advice and went with the auction idea. After the auction that night, he again explained everything to us that would happen from then until settlement day. At alltimes we found Gerry to be an outstanding, friendly, professional land agent. At no time did we ever wonder what was happening. He kept us informed at all times. We would have no hesitation in recommending him to any family or friends who may need to sell their properties. We have certainly put his name in our diary for when the time comes to sell our property. To know that you can trust your land agent to do the right thing by you is very comforting.
