25.01.2022 Happy fathers day



25.01.2022 Jobkeeper October monthly declarations are due soon if you are eligible for JK 2.0 The JobKeeper Payment scheme has been extended until 28 March 2021, see Jobkeeper extension. From 28 September 2020 employers need to demonstrate that their actual GST turnover has fallen against a comparable period... tier 1 and tier 2 JobKeeper rates apply and are generally based on average hours worked by employees. For the JobKeeper fortnights starting 28 September 2020 and 12 October 2020 only, we are allowing employers until 31 October 2020 to meet the wage condition for all employees included in the JobKeeper scheme. Employers do not need to re-enrol to claim payments in the first extension if they are already enrolled in JobKeeper. They just need to check their continuing eligibility and submit this information to us online from 1 October 2020. Employers also need to tell us the payment tier they are claiming for each eligible employee or business participant in their November monthly business declaration. As our systems will be unavailable over the weekend, we will continue to process monthly declarations to reimburse employers for October payments past this due date. https://www.ato.gov.au/general/jobkeeper-payment/

24.01.2022 A few employers and their advisors are still making significant errors with JobKeeper. Its crucial to get it right. Here is one common mistake - thinking that ...if employees are working normal hours, then the employer only has to pay statutory super on the wage amount that is in EXCESS of the JobKeeper payment. Super is only NOT payable where some or all of the payment is a JobKeeper top up payment in addition to the hours an employee has worked, to meet the minimum JobKeeper $1500 per fortnight payment. Super is also not payable for the JobKeeper when no hours are being worked at all, specifically when a JobKeeper directed stand-down is occurring. Where JobKeeper has become a subsidy payment to the employer, as it has when employees are working usual hours and are therefore entitled to payment in excess of the JobKeeper amount, the employees must be paid statutory super on all ordinary hours worked, allowances and commissions, as per usual. 22.01.2022 The High Court has overturned the Federal Courts decision on Mondalez re sick leave accrual. The Federal Court had previously found that two 12 hour shift work...ers were entitled to 120 hours personal (sick) leave under section 96 of Fair Work Act which permits 10 days of personal leave. The Federal Court made this decision even though the two employees weekly ordinary hours were less than 60. Their employer had argued that they were entitled to 10 x 7.6 hours on the basis that 7.6 were their daily ordinary hours, even though the employees worked 12 hour shifts on each day of a week they were rostered on. The High Court has now decided that 10 days accrual of personal leave means 2 weeks of ordinary hours, regardless of the number of hours rostered in single daily shift. This will be pro rated on a weekly ordinary hours basis, for permanent part-time employees. So in summary, accrual and payment of sick leave is now on the basis of a fortnights ordinary hours divided by 10, rather than referencing the number of hours in a single shift. The Mondalez decision did cause a lot of confusion in the murky waters of the alleged very limited capacity of Australian payroll software, so hopefully that is a positive from the High Court decision. 17.01.2022 Did you see our article on the P&Cs QLD infoplace? The Federal Government has announced a number of significant changes to the JobKeeper program which will co...mmence from 28 September 2020 until the new end date of the program on 28 March 2021. These changes will have a significant impact on employees who are currently receiving JobKeeper as well as operations which have been receiving the subsidy. In short, the changes create a two tier system for employees. Employees who worked less than 20 hours a week before the Pandemic, and the rest. The changes also introduce an obligation on an Employer to demonstrate that they continue to need the subsidy by showing a 30% loss compared to the same period in 2019. This is a major change as previously an organisation was only required to qualify once (in March 2020) and then they were covered for the duration of the program. The ATO are allowing employers till 31st August 2020 to met the wage condition for new employees eligible under the 1st July eligibility test. Top ups must be completed by close of business today.

16.01.2022 Today is the last day for the super guarantee amnesty. The super guarantee (SG) amnesty is a one-off opportunity to correct past unpaid SG amounts. Employers have a six-month window, until 7 September 2020, to disclose, lodge and pay unpaid SG amounts for their employees. Employers can claim deductions and not incur administration charges or penalties during this amnesty. To remain eligible, you must declare and pay your SG shortfalls and interest charges. Payments made durin...g the amnesty can be claimed as tax deductions, and payment plans can be arranged. Applications for the amnesty close at 11.59pm on 7 September 2020. Only payments made before 11.59pm on 7 September 2020 will be tax deductible. As the changes to withholding are made part way through the income year, employers and other payers who are unable to immediately implement these changes into their payroll will have until 16 November 2020 to do s...o. Employees and other payees will receive their entitlement to the reduced tax payable for the entire 202021 income year when they lodge their income tax return.

05.01.2022 If youre under JobKeeper, your boss can require you to change duties using a JobKeeper enabling direction, but there are rules. So, unless you normally do dome...stic work for your boss, you shouldnt be cleaning their house. Your boss can direct you to change duties, but the new duties must be: safe, including considering the nature and spread of coronavirus within the scope of your skills and ability and you must hold any licenses or qualifications required to do the job, and reasonably within the scope of your employers business operations. There are other rules, too. So, for example, your boss also needs to discuss the changes with you and give you at least three days written notice before giving you the direction, unless you agree to less. Also, your pay cant be reduced for doing different duties. If the duties attract a higher base rate, you need to be paid at that higher rate. 02.01.2022 Legislation has passed Parliament that extends the JobKeeper provisions in the Fair Work Act. The extended provisions take effect from 28 September 2020 and the... last day that they apply is 28 March 2021. There have been some changes made in the new provisions including allowing some employers, known as legacy employers, to continue using some of the extended JobKeeper provisions for their previously eligible employees if they meet certain conditions. The previous JobKeeper provision allowing employers to make agreements with eligible employees to take annual leave has been repealed and stops applying from 28 September 2020.
