17.01.2022 This week, the justice system had a win with the official reopening of the drug courts in Queensland. We at Queensland Law Society were very pleased to see this... come to fruition, after advocating for their reintroduction since they were scrapped in 2012. The biggest push for these courts came with our 2015 Queensland State Election Call to Parties document, where we listed this as a key issue. Following the State election, our QLS Criminal Law Committee made submissions to Parliament and appeared at the public hearing to encourage this legislation. 16.01.2022 This morning president Christine Smyth spoke about the Mental Health Court, what can happen if a defendant is found to be of unsound mind and protecting the com...munity and the individual. "We must balance community safety and expectation against a just society. The measure of a society is how it treats its most vulnerable. "We do not punish people for having a mental illness, we ensure that they are placed in a secure facility and receive the treatment they need." Ms Smyth said.

15.01.2022 Do you have an elderly relative who wants to make significant changes to their will or power of attorney? If you do, it is best practice to get their GP and/or treating doctor to provide a written assessment of their "capacity" (i.e ability to make a legally binding document - doctors can undertake such an assessment). The purpose in doing this is that it will make it harder to have the will/power of attorney overturned/declared void (i.e a significant departure from the previous will can be open to challenge by disgruntled beneficiaries).

15.01.2022 The long awaited amendments to the Retail Shop Leases Act 1994 (Qdl) (RSLA) commenced on 25 November 2016. An example of some of the breadth of the amendments to this act are that the RSLA will no longer apply to any retail shop with a floor area of more than 1000 metre square. 09.01.2022 GLR Law recommends that all clients who are buying a property ensure that the contract is subject to building and pest. If a contract is subject to building and pest, the client can organise a building and pest inspection of the property to ensure that there are no major issues with the property (i.e termites). If there are major issues with the property that are found during the building and pest inspection, clients are able to terminate the contract with no financial penalty.

04.01.2022 In Kennedy & Thorne [2016] FamCAFC 189 (26 September 2016) the court established that the fact the husband required the wife to sign binding financial agreements before marriage was not enough to establish that the wife was under duress to sign the agreements. The court found that she had sought legal advice, had been told not to sign the agreements but had anyway. Appeal by the husbands estate was allowed.

In Queensland, a solicitor is required to hold a practising certificate to be legally allowed to give advice and anyone who wants to make sure their representative is certified can do so by contacting the Queensland Law Society or via its website.

02.01.2022 In Prince Alfred College Incorporated v ADC [2016] HCA 37 the High Court of Australia held that the relevant principals to be applied in deciding whether an employer is responsible for the negligent actions of its employees was as follows: 1. To consider any special role that the employer has assigned to the employee and the position in which the employee is thereby placed vis-a-vis the victim; 2. In determining whether the apparent performance of such a role may be said to g...ive the occasion for the wrongful act, particular features may be taken into account. They include: a) authority; b) power; c) trust; d) control; and e) the ability to achieve intimacy with the victim. The latter features may be especially important. In the context the "particular features" should be read as each being over or with respect to the victim.
