24.01.2022 Today on National Police Remembrance Day, we remember and honour Police Officers across Australia who have given their lives in the line of duty. We salute the many courageous officers who protect and support our communities, often giving sacrificially to do so. The QPS invites everyone to watch the live streamed service today at 10am (livestream.com/queenslandpolice/events/9282768), wear a blue ribbon or take part in the online candlelight vigil (light a candle and consider sharing it to social media with the hashtag #NPRD2020).

13.01.2022 The Queensland Law Reform Commission has this month released a Consultation Paper entitled, A Legal Framework for Voluntary Assisted Dying. The Commission has also been clear in its purpose, noting that their job is not to decide whether voluntary assisted dying is desirable or otherwise, but to create an appropriate legal framework for the issue. The Consultation Paper references the multifaceted and often controversial nature of the matter stating: Voluntary assisted d...ying is a very complex and deeply personal issue that requires the balancing of a range of competing considerations, including respecting human rights and the dignity and autonomy of individuals, while also taking into account the need for safeguards to protect individuals who might be vulnerable to coercion or exploitation. 12.01.2022 Australia’s Attorney-General Christian Porter has released draft legislation regarding a proposed Commonwealth Integrity Commission (CIC). 12.01.2022 On this day in 1913, Ernest Austin became the last person to be executed in Queensland for the rape and murder of Ivy Mitchell in Samford, Qld. Leading the way for other states to follow, Queensland was the first state of the British Commonwealth to abolish the death penalty, passing the official bill in 1922 (the vote was 33 - 30). It would take another 46 years for the next Australian state (Tasmania) to follow suit in 1968, with the last two states finally abolishing the death penalty in 1984.

08.01.2022 The High Court of Australia has today appointed two new Justices to the bench. The Honourable Justice Simon Steward and the Honourable Justice Jacqueline Gleeson will replace retiring judges Geoffrey Nettle and Virginia Bell. 07.01.2022 Today the Qld Court of Appeal handed down their decision in the case of Commissioner of Police v Barbaro. The case focused on whether the protection of privileged information was a reasonable excuse for refusing to give police access information to a mobile phone. Read on for a summary of the trial, District Court Appeal and the Qld Court of Appeal’s findings. In Qld a Magistrate may issue a search warrant requiring a person to give police access information to a mobile phone.... It is an offence not to comply without a reasonable excuse. In the case of Harley Barbaro, he refused to provide access information and was charged. At trial he gave evidence that he had refused to reveal the password as he had used the phone to communicate with his solicitor through various text messaging systems. The phone contained privileged written communications between the respondent and his solicitor. It was claimed that his right to protect privileged information constituted a reasonable excuse for refusal. The learned Magistrate rejected this defence and found Barbaro guilty. The respondent appealed to the District Court and Kent QC DCJ upheld his appeal. In substance, Kent QC DCJ accepted that he was entitled to maintain his privilege against disclosure of certain information, even if other information on the phone was not privileged, and this constituted a reasonable excuse for refusal. His Honour set aside the conviction. Today the Qld Court of Appeal unanimously dismissed an appeal by the Commissioner of Police, upholding the decision of Kent QC DCJ. Sofronoff P held: In this case the demand made of the respondent to reveal the password that would unlock his phone was made in terms that did not suggest that police accepted any limitation upon their powers of inspection of documents that they found on the phone. Police were asserting a right to read every document on the phone. You can read the full judgement at https://archive.sclqld.org.au/qjudgment/2020/qca20-230.PDF

07.01.2022 After a 9 month Inquiry, the following report has been produced by The Queensland Sentencing Advisory Council, calling for harsher penalties for those that assault police and other frontline workers. No matter what their job is everyone has a right to feel safe in the workplace and shouldn’t be worried about being assaulted. - Former District Court Judge and QSAC Chair John Robertson

07.01.2022 Shocked and saddened to hear about the passing of cricket legend Dean Jones last night. An always energetic batsman, Dean famously scored a double century in Chennai in 1986, despite scorching conditions and suffering from extreme dehydration. Purportedly told by Allan Border to toughen up or Allan would find a Queenslander to do the job, Dean courageously pushed through to help Australia to a celebrated tie against India. Dean will forever be remembered as a cricketing great and our thoughts are with his family during this difficult time.

04.01.2022 Traffic Offences (Road Rules) - Traffic offences encompass numerous road rule breaches ranging from speeding, failing to give way or stop at a designated traffic sign, failing to stop at red or orange traffic light, failure to wear a seat belt and much more. Traffic offences can also include driving with an expired drivers license, driving whilst unlicensed or driving whilst disqualified from driving. All of these offences usually carry with them a requirement for the court t...o disqualify the person's drivers license from 1 month up to 5 years or in some serious cases indefinitely. There is not always an option to apply for a workers license or a hardship license. All of these offences are determined in the Magistrates Court before a Magistrate (not a jury). Although these offences immediately seem minor in nature it is important you take up our offer of a free no obligation case appraisal so you understand exactly what the consequences are for any action you take before the court.
