25.01.2022 Australias legal system is derived from which Country? A. England B. United States of America C. Canada D. Germany
25.01.2022 Penalty units are a quick and simple way for the legislators to increase the value of a fine to keep pace with inflation or public policy, rather than having to change every law which involves a fine every time the value of a fine is to be varied. It avoids the administrative costs that come with constantly updating legislation with new fine values. Even for those states where the value of the penalty unit is legislated, a change to the value requires only a single amendment. Read more: https://www.gotocourt.com.au/criminal-law/penalty-units/
22.01.2022 Did you know? If an #insolvent debtor dies leaving insufficient assets to pay their debts, any creditor or creditors who are owed $5,000 or more, or the person who is administering the estate of a deceased person, may seek an order for the administration of the estate in bankruptcy. The estate is made bankrupt in the same way as a living debtor is made bankrupt and the requirements are similar to those that apply in relation to creditors petitions against debtors that are alive. A major difference is that there is no need for an act of bankruptcy by either the deceased debtor or the legal personal representative of the deceased debtor. 22.01.2022 Crimes have what is known as essential elements and these elements must each be proved by the prosecution for a person to be found guilty of the offence. If a defence removes one of these elements it will prevent the prosecution from proving their case beyond a reasonable doubt. The defences all have their roots in the common law and some are now set out in legislation. Some offences have specific defences that apply to them as set out in the Crimes Act 1900, such as the defence of lawful correction to a charge of assaulting a child. 19.01.2022 Tenant rights and obligations in respect of the payment of #bond are generally quite straightforward. Prior to moving into the property the tenant will most likely have to pay to the landlord a bond deposit to be held until the tenancy has ended. The maximum amount of bond the landlord can charge is 4 weeks rent. The landlord must lodge the bond with Fair Trading #NSW. Once it has been lodged, you will receive a lodgment notice confirming they have received the bond. If you do not receive a lodgment notice, you can contact Fair Trading NSW to confirm they received your bond from the landlord. 10.01.2022 Breach of Bail in New South Wales When you are granted bail you have to sign an acknowledgment of the bail and its conditions before you will be released. By signing this you are agreeing to comply with all of the bail conditions. If you dont, it is called a breach of bail. You can breach a bail in two ways, either by breaching a condition of your bail or by failing to appear in accordance with your bail undertaking. A failure to comply with a bail condition is not an offence but it can lead to the bail being reconsidered by the court. Failing to appear in accordance with a bail acknowledgment is a criminal offence. In New South Wales the law on Bail is contained in the Bail Act. 07.01.2022 Good behaviour bonds in #NewSouthWales are generally governed by the Crimes (Sentencing Procedure) Act 1999. A good behaviour bond is an order from a magistrate that a person be of good behaviour for a specified amount of time, with or without other conditions. The bonds allow an offender to be released into the community rather than serve time in jail. The conditions of the bond must be accepted by the defendant, who signs the bond as a promise to comply with it. For som...e offences, a fine can be imposed in addition to the bond for a single offence. However, a community service order cannot be imposed with a bond for the same offence.
