22.01.2022 National Cabinet has now issued a Mandatory Code of Conduct with respect to Commercial Leasing comprising retail, office and industrial tenancies. This Code applies if the tenant is a business eligible for JobKeeper program with a turnover of less than $50 million. The following principles are some that are announced by the Code: 1. Landlords must not terminate leases due to non-repayment. 2. Landlords must offer proportionate rent reductions by way of waivers or deferrals. ... 3. No fee, interest or other charges should be added to the rent waiver or deferral. 4. Reductions in statutory charges such as council rates should be proportionately passed to the tenant. 5. Benefits offered by financial institutions to the landlords should be proportionately passed 6. No rent increases to take place during the pandemic period and a reasonable recovery time. 7. If an agreement is not reached between a landlord and a tenant, Mediation should be attempted. This Code applies from 3 April 2020 until the JobKeeper program remains operational. 18.01.2022 Remote Witnessing of Documents Due to COVID19, the regulation now permits witnessing of documents such as wills, powers of attorney, enduring guardianship appointments and affidavits to occur via Audio Visual Link. Despite this flexibility, care still must be taken to ensure compliance with this regulation and other applicable rules such as s 6(1)(c) Succession Act 2006 which requires a will maker to also observe two witnesses sign the will. The remote witnessing regulation will expire 6 months from 22 April 2020.
