24.01.2022 SKILLSELECT INVITATION RESULTS OCTOBER 2020 October invitation round invites were issued to: 189 Skilled Independent Visa = 30 invitations... 491 Skilled Work Regional (Provisional) visa = 80 invitations While the invitation mark was low invitations were primarily issued to medical, health and science professionals. The States and Territories Nomination Program (190/491) is still on hold for the 2020-21 program year and will hopefully open shortly. Each State/Territory will determine their occupations lists and set their requirements for nomination. Based on the migration program planning levels the majority of skilled permanent visas for 2020-21 are expected to go applicants already in Australia or those on the Priority Migration Skilled Occupation List: Employer Sponsored: 22,000 Skilled Independent: 6,500 Regional: 11,200 State/Territory Nominated: 11,200 Business Innovation & Investment program: 13,500 Global Talent: 15,000 Distinguished Talent: 200 Skill Total: 79,600

23.01.2022 CAPS ON INTERNATIONAL PASSENGER ARRIVALS TO AUSTRALIA Extract from the National Cabinet Media Statement of 7 August 2020. National Cabinet agreed that existing caps on international passenger arrivals would continue in order to manage and maintain quarantine arrangements across jurisdictions.... Until 24 October the following will apply subject to further advice on quarantine capacity: Sydney limit of 350 passenger arrivals per day; Perth limit of 525 passenger arrivals per week; Brisbane limit of 500 passenger arrivals per week; Adelaide limit of 500 passenger arrivals per week; Canberra, Darwin passenger limits on each flight to be discussed with jurisdictions on a case-by-case basis; Hobart no international flights. The suspension of international flights into Melbourne will also continue. National Cabinet agreed that information relating to quarantine capacity and passenger demand would continue to be exchanged and support flexibility within the caps to as much as possible to minimise disruptions to returning Australian citizens and permanent residents. These arrangements will continue to be reviewed by National Cabinet. Restrictions on outbound travel by Australian citizens and permanent residents remain in place, in accordance with the health advice to the Government.

23.01.2022 PRIORITY MIGRATION SKILLED OCCUPATION LIST ENHANCED LABOUR MARKET TESTING The occupations included on the Priority Migration Skilled Occupation List (PMSOL) were identified based on advice from the National Skills Commission, and in consultation with other relevant Commonwealth agencies, and will be reviewed regularly.... Existing skilled migration occupation lists will remain active and applications will still be processed, but priority will be given to those relating to occupations on the PMSOL. Prioritisation of applications relating to PMSOL occupations will only apply to employer sponsored visa programs. Current labour market testing (LMT) requirements have been enhanced to ensure that Australian workers are prioritised for job opportunities in Australia. (subclass 457, 482 and 494) The enhanced labour market testing requirements apply to nominations lodged on or after 1 October 2020 to ensure that appropriately skilled Australian citizens and permanent residents are given work opportunities before overseas workers when a business nominates a vacancy. Given the economic impacts of COVID-19, the Australian Government has an expectation that positions will be advertised on Jobactive before seeking to nominate an overseas worker for a permanent employer sponsored visa (subclass 186 or 187), in order to demonstrate that there is a genuine need for an overseas worker to fill that position. 22.01.2022 2020-21 OCCUPATIONS CEILINGS FOR SKILLED INDEPENDENT Sc189 & SKILLED REGIONAL (PROVISIONAL VISAS) Sc491 - Family Sponsored Note: These occupation ceilings DO NOT APPLY to State or Territory Nominated, Employer Sponsored or Business Innovation and Investment visa subclasses. EXTRACT... An occupation ceiling may be applied to invitations issued under the independent, skilled regional (provisional) visas. This means there will be a limit on how many EOIs can be invited for skilled migration from an occupation group. This ensures that the skilled migration program is not dominated by a small number of occupations. Once this limit is reached, no further invitations for that particular occupation group will be issued for that program year. Invitations will then be allocated to intending migrants in other occupation groups even if they are lower ranking. See occupation ceilings tab on this page (link below). EXTRACT - Temporary graduate and skilled workers will be offered an additional five years of work rights in Australia on top of the time theyve already been in Australia, with a pathway to permanent residency at the end of that period.... - Students will be eligible for a five year graduate visa from the conclusion of their studies, with a pathway to permanent residency at the end of that period. . - Future Hong Kong applicants for temporary skilled visas will be provided with a five year visa, based on meeting the updated skills lists and Labour Market Testing requirements. - Existing arrangement will continue to apply for those applicants who study and work in regional areas to help address skills shortages in those areas, with pathways to permanent residency after 3 years. 19.01.2022 NSW STATE SPONSORSHIP UPDATE NSW Business and Skilled Migration Skilled is close to filling its interim allocation of nomination positions for the 2020-21 program year provided by the Department of Home Affairs. Following the Commonwealth Government’s announcement of the annual migration program planning levels, an additional provision of nomination positions for the reminder of the year may become available in the coming weeks.... Further information will be provided on our website once the allocation of nomination positions has been finalised. SKILLED MIGRATION NSW will continue to operate an expression of interest and invitation model to address NSW’s skill needs. Under direction from Home Affairs, NSW will continue to priorities applicants with skills to support NSW economic recovery and public health response. We will only invite applicants currently in selected health, ICT and engineering occupations, and who are residing in NSW. REGIONAL MIGRATION NSW will shortly announce changes to the management of the Skilled Work Regional Visa (subclass 491). Data collected will include information on visa holders and applicants, sponsors, education providers and Registered Migration Agents. The data will be acquired and matched with ATO data holdings to identify non-compliance with obligations under taxation and superannuation laws.... 18.01.2022 UPDATE MIGRATION PROGRAM PLANNING The MIA advised last night that it is expected the DHA will consider changes to the Migration Program Planning Levels for 2020-21 due to the COVID-19 in the October Federal Budget. An economic and fiscal update will be provided by the Treasurer on 23 July 2020. In the interim, the Department has indicated that the 2019-20 Migration Program settings will remain in place until further notice and will also shortly announce how state/territory n...ominations will be managed in the lead up to the October Budget. The State and Territories nomination program will remain temporarily CLOSED until the Commonwealth Government allocates state nomination places for 2020-21. State & Territory governments therefore have no ability to nominate applicants in visa subclass 190 & visa subclass 491. At this stage we do not have any further information as to how the State & Territory governments will manage their program but will keep you informed as we receive updates.

The full nomination allocations for 2020/21 will be determined later in the year as part of the 2020/21 Budget process.... Given the limited number of available nominations, South Australias program requirements and application processes for the General Skilled and Business Programs are currently being finalised, with a view to applications being open in late August 2020. 13.01.2022 STATE & TERRITORY SKILLED VISAS The State and Territory Governments have been given a very small allocation of places for Skilled Work Regional (Provisional) visa (subclass 491) and the Skilled Nominated visa (subclass 190). This allocation of places is to only be used for occupations that are critical to the COVID economic recovery. The critical occupations and industry sectors are listed on the DHA website as:... critical skills required to maintain the supply of essential goods and services (such as in medical technology, critical infrastructure, telecommunications, engineering and mining, supply chain logistics, agricultural technology, food production, and the maritime industry) delivering services in sectors critical to Australias economic recovery (such as financial technology, large scale manufacturing, film and television production and emerging technology), where no Australian worker is available This allocation will be in place until the Federal Budget is handed down on 6 October 2020. NSW UPDATE: NSW is currently closed to applications for nominations under the Sc491 and 190 program. NSW will open to new nominations once the Commonwealth Department of Home Affairs provides the State with an allocation of positions for 2020-21. Invitation rounds for NSW nomination under the Skilled Nominated visa (subclass 190) will also commence at this time. At this stage NSW are unable to advise when this will occur.

Returning travellers will be required to pay for hotel quarantine. All returning travellers must go through Sydney Airport unless they are in a border town. QLD: Queensland will enact a hard border closure with NSW and the ACT from Saturday 8 August, with returning travellers required to pay for hotel quarantine.

10.01.2022 STATE / TERRITORY NOMINATION UPDATES (190/491 VISA) The migration program is designed to meet Australias economic and social needs. The migration program year runs from 1 July to 30 June. Each State/Territory is allocated a number of nomination places by Government. The State/Territory Governments generally review their skilled lists and requirements at the beginning of each migration program year based on the skills needs across a range of industry sectors ... The Department of Home Affairs had advised the State/Territory Governments they will not receive nomination allocations for skilled visa subclasses 491 & 190 on 1 July 2020, therefore the State and Territory Governments are unable to nominate either existing or intending applicants in those two visa subclasses for the time being. This is not the first time the Department of Home Affairs has delayed releasing nomination allocations on 1 July. At this point the State/Territory Governments are unable to advise when they expect their nomination lists to reopen. The Department of Home Affairs may make further announcements to the State and Territory governments about nomination allocations ahead of the 2020-21 Budget being handed down on 6 October 2020. We will provide further updates as information becomes available.

This means that the Northern Territory (NT) Government is currently unable to issue nominations under the General Skilled Migration (GSM) program and the Business Investment and Innovation Program (BIIP).... At this stage, if you are currently living in the NT, you will still be able to lodge new applications for NT nomination under the GSM program, and these applications will continue to be assessed. 01.01.2022 UPDATE 2020-21 MIGRATION PROGRAM PLANNING & DELIVERY The DHA has issued and update on the impact of the COVID 19 crisis on 2020-21 Migration Program Planning and Delivery. EXTRACT:... The Australian Government is considering how best to shape the Migration Program to drive economic growth and support job creation during this post recovery phase. This will take into consideration the economic conditions in Australia, future skill needs, changes in the labour market and the population objectives of states and territories. Until otherwise advised, the existing 2019-20 Migration Program settings will continue to remain in place. This means the 2020-21 planning ceiling will be retained at 160,000 places, the level set for the 2019-20 Migration Program. This includes: 108,682 places for the Skill stream. 47,732 places for the Family stream. 236 places for the Special Eligibility stream. 3,350 places for Child visas Nominations will be made available to States and Territories in line with these considerations, in the following categories: Skilled Nominated (subclass 190) Skilled Employer Sponsored Regional (Provisional) (subclass 491) The Department plans to proceed with engagement with State and Territory governments regarding their nomination allocations for the 2020-21 Migration Program. Targeted invitation rounds have continued each month for the Skilled Independent (subclass 189) and Skilled Work Regional (Provisional) (Family Sponsored) (subclass 491) and prioritise skills which are in critical need and will aid Australias economic recovery.
