25.01.2022 As the unprecedented Coronavirus pandemic continues to develop, we wish to assure our clients that Gramelis Attorneys is committed to the safety of our clients and patrons and that we are well prepared and fully equipped for a range of possibilities. Whilst, first and foremost, we believe it is important to remain level-headed during this trying time, we are proactive in monitoring the Federal and State Health Departments bulletins and implementing recommendations as to hygi...ene and other measures. For the time being, our measures include: 1. Regularly disinfecting our office facilities and insisting on high standards of hygiene from staff. 2. Limiting travel and making use of on-line Court Registry facilities rather than attending registries in person. 3. Requesting Courts to permit appearances by telephone or remotely. 4. Using tele-conferencing facilities where practicable to communicate with clients and third parties and limiting in-person contact, particularly with anyone who has had exposure or showing symptoms of illness. 5. Requesting our staff to exercise social distancing outside of work hours and to avoid large gatherings where practicable. Not only is the safety of our staff and clients of the highest priority to us, but we wish to assure our clients that we stand ready to continue to be of service to you during this difficult time and that we have a Business Continuation Plan in place to ensure continuity of service and minimise as much as possible the impact of the pandemic on the provision of legal services by our firm. We have been working closely with our IT partners and this includes, if necessary and should circumstances require it, our team working remotely with full access to our office systems. Police are increasingly using technology in their day-to-day enforcement of the law, from highway patrol cars equiped with in-car cameras to body-ca...ms that record everything you say. But with the advent of smart phones, say for example you were pulled over, would you be within your rights to video record the police? The NSW Police media policy says members of the public have the right to take photographs or film police officers which are observable from a public space or from a privately owned place with the consent of the owner or occupier The effect of this policy is that unless you are hindering police, resisting arrest, disobeying a lawfully issued move-along order, and subject to certain other exceptions, the police generally dont have the power to prevent people from taking photographs or filming, or request or order them to delete the images or recordings. 21.01.2022 Did you know that if you pass away without a valid Will, your estate will be distributed to eligible relatives in accordance with a prescribed statutory formula and order of priority, and if you do not have any eligible relatives at the time of your death, your assets will pass to the State. Making a valid Will gives you and your loved ones the peace of mind that comes from knowing that you have made your testamentary wishes known in a formal, legally binding document and tha...t, in the event of your death, your assets will be distributed according to your directions to the persons whom you want to benefit from your estate rather than in accordance with an arbitrary statutory formula. Having a valid Will also means you can put a trusted person of your choosing in charge of overseeing the administration of your estate, which is not necessarily the case if you die intestate, i.e. or without a Will. You may already have a Will. If so, you should consider having it reviewed, particularly if it was made some time ago, or you have since undergone a separation or divorce, or if your circumstances have changed. A valid but badly drafted Will might be ineffective in making clear your testamentary wishes, or might fail in part. 04.01.2022 Some of you may be aware of some changes that are expected to take place in the family law system as of early 2019. Up until now there have been two main courts dealing with family law matters. These are the Family Court of Australia which, deals with more complicated matters, and the Federal Circuit Court of Australia, which determines the majority of matters. For some time there have been long delays in having cases determined by the family law courts. This has mainly been ...caused by insufficient funding and resources to deal with the influx of matters being filed in those courts. The federal government has been conducting enquiries into how to improve the system and has recently announced that it will be overhauling the court system in this area by abolishing the current courts and combining them into a new court to be called the Federal Circuit and Family Court of Australia. The new court will consist of two divisions. Division 1 will, in effect, carry out the role of the former Family Court of Australia, and Division 2 the work of the former Federal Circuit Court of Australia. Appeals from the new court will no longer be heard by the Full Court of the Family Court but rather a new division will be established in the Federal Court of Australia called the Family Law Appeal Division to hear these appeals. How far this will go toward solving the problems that have been plaguing the current courts remains to be seen; however, we expect that there will be ongoing reforms in this area for some time to come, and for the procedures of the new court to be focused on dealing with matters faster and more efficiently. How is this going to affect clients? Apart from the amalgamation of the courts, there are likely to be new Court Rules and forms to comply with. But there is no need for alarm. If your matter is already in the current court system, as with most new legislation, it is usual for there to be provisions governing the orderly transition from the old system to the new. In fact, the judges of the current courts are likely to remain as judges of the new court within their respective divisions. If you commence proceedings after the new system comes into effect, then you will need to comply with the new Rules and use the new forms. Having said that, in our experience there is normally a grace period and there is every likelihood that while some new forms may be introduced, the majority will be the same or similar to the present. As always, if anyone has any queries, please feel free to speak to me about them. Id be interested on peoples thoughts on the proposed changes; particularly, whether anyone feels they are likely to make a difference. I would have thought the simplest answer would be to retain the Family Court and simply appoint more judges. This proposed new system, while I hope it works, seems like an overly complicated response.
