22.01.2022 Christmas for Separated Parents. This time of year can be very difficult for separated parents. For some ex-couples, the Christmas holidays are one of the biggest hurdles to overcome. Who has the kids Christmas morning? Who has the kids Christmas eve? How much did my ex spend on presents? Is my ex taking my kids on holidays with the new partner? It is a 6 week holiday, and with many separated parents doing the half holidays arrangement, it can be an extremely long 3 weeks.... Especially the first year. Whilst it is not anything resembling legal advice, here are some ways to get through this time. Or maybe more importantly if you know someone who is in this situation, here are some ways to help them. Get along with the ex. Really make an effort. Imagine the image the kids will have in their minds if they know that Christmas day changeover is that difficult time when mum and dad insult each other. Arrange time with your children beforehand. If you haven’t got orders or a plan in place (you should), then try to reach agreement so there are not any ugly situations. Be with family and friends. Many single parents want to isolate themselves. This leads to depression in many cases. Even if it means putting on a brave face, get out there and you might just enjoy yourself. Don’t drink too much, especially if your mind is not in a good place. A few drinks with work mates can be fine, but in the wrong situation having too much alcohol can affect your judgement and see some unresolved issues raise their ugly head. If you have separated, and there is dramas between you and the ex in relation to the children, see a lawyer. It does not have to be adversarial. A letter from a lawyer basically saying for the good of the children, and so we both know where we stand, we should put something into place can be a great start. There are so many trained professionals between lawyers, and relationship centres, and mediators, that there really is no excuse for making a difficult situation much worse. To avoid ugly situations, you should formalise your arrangement as soon as practical. It may be much easier than you think. Only around 1 in 20 children's matter get to Court so there is a great chance of settling your differences. See more
19.01.2022 Free wills for front line workers, and our aged citizens. The NSW Criminal Courts have significantly adjourned and vacated matters at the moment, and there are indications that it could be months before returning to normal. This means that the time required on preparing and conducting Criminal hearings has reduced in the near future.... Whilst many other areas of law remain conducted in the usual way, this Coronavirus situation provides me an opportunity to assist those who may be considered to be at either a higher risk of contracting Coronavirus, or those who may be considered to suffer more serious consequences of Coronavirus. Therefore, every Thursday, until the end of May, I will draft and store wills free of charge to the following groups of people. This of course, is subject to the client being capable of legally being able to give instructions and execute the will. The 2 categories are; Any 000 responder, and all employees of Hospitals and Medical offices (including reception staff). Anyone over the age of 70. Please make reference to this Coronavirus offer when making the booking on 66424044. Please make the bookings from 9.30-2 each weekday .This is subject to my availability of each Thursday until the end of May. Of course, the children of the elderly are welcome to make the appointment on their behalf. I hope to (in a small way) be able to reduce one aspect of concern to the above people, and their families.

Face to face appointments can still be catered for. We will simply ask you to use our alcohol based hand rub when you enter, and from across the table, I can take all instructions as normal. Court appearances, Conveyancing, Family matters,are still being managed. Ironically, the desired distancing, and the new Court proceedings announced due to Corona, actually appear to make the processes easier for clients, allowing them to stay home, ultimately for the greater good of their families and friends. 05.01.2022 Witnessing Wills over Facetime? Yesterday (22/4/20), the NSW Attorney General, announced a temporary Regulation to allow signatures to be witnessed via Facetime (or similar) as long as it's seen by the person witnessing in "real time". This should allow me to witness wills, whilst the will-maker remains in their home, or facility. In conjunction with my offer for free Wills to 000 responders, or anyone over the age of 70, until the end of May, it's a great chance to have some...one's affairs put in order. Video conferencing technology like Skype, WhatsApp, FaceTime and Zoom can now be used in the witnessing of important legal documents like wills, powers of attorney and statutory declarations under a new regulation made this morning by the Governor. Attorney General Mark Speakman said the new temporary regulation, made under section 17 of the Electronic Transactions Act, will help reduce face-to-face contact during the COVID19 pandemic. Thousands of legal documents are executed every day in the presence of one or more witnesses, but COVID-19 restrictions have made it difficult for many people to do so in person, Mr Speakman said. Our first priority is always the safety and wellbeing of NSW residents, which is why we are changing the way these documents can be witnessed while the pandemic endures. Under the new regulation, a witness must see a person signing the document in real time to confirm the signature is legitimate, but now they can do so using video conferencing technology. The witness will sign the document, or a copy of the document, to confirm they witnessed the signature. This could be done on a hard copy that is scanned and sent to the witness or on an identical counterpart of the document the signatory signs. Traditional methods of signing and witnessing these documents remain valid while the regulation is in force. These changes will make it easier for people to stay home and reduce physical interactions, while still completing important transactions. To facilitate the witnessing of NSW statutory declarations during COVID-19, the categories of people who are authorised to witness documents has been expanded in line with federal legislation. Stakeholders including the judiciary, the Law Society of NSW, the NSW Bar Association, Justice of the Peace associations and other relevant professional bodies were consulted on the changes. The Government will continue to consult with stakeholders about options for allowing certain documents to be signed and executed electronically.
