18.01.2022 Affidavits, Wills, General and Enduring Powers of Attorney can now be witnessed over video conference in the ACT. This is in effect today, 14 May 2020 after the ACT Government’s release of the COVID-19 Emergency Response Amendment Act 2020. The law allows for the witnessing of documents via audio-visual link which means that this can be done via FaceTime, Zoom, Skype, WhatsApp, or any other form of communication that allows the signatory and the witnesses to see and hear each... other at the same time. The key requirement is that the witness must observe the signatory signing the document in real time. Once observed, the witness may then either sign a counterpart document, or the signatory can scan and send the signed version of the document to the witness who then signs the document as soon as practicable after witnessing. A statement must also be completed confirming the execution of the document in accordance with the new law. At home, throw out (securely) those old bank statements. For businesses, the Privacy Act has a requirement to only store personal information for as long as you need it - and to delete it when it's no longer needed. It may not seem like it, but electronic data takes up space too! When you stop ...using an online service, remove the personal data that you can.
