25.01.2022 SHOULD I MEDIATE? Mediation can be a great alternative to seeking a court determination of a dispute whether it is with your spouse, a friend or business partner. Why?... It can be arranged quickly It is cost effective, rarely requiring more than one day It can be undertaken with or without lawyers You can discuss all concerns or focus on those that are fundamental to a resolution It is not necessarily about winning or losing it is about solving the issue It places you and the other party in a position to find a solution that works for you both not one that a Judge may otherwise impose on you You may not leave the mediation happy with the outcome, but you should leave with a result that you can live with. 23.01.2022 You can still update your Will during a pandemic (and why you should) On 22 April 2020, the Supreme Court of Queensland gave Will makers (and lawyers) some concessions for witnessing requirements during COVID-19. If you are quarantining, vulnerable and directed to isolate or otherwise locked down, you can still update your Will by video conference provided that, between 1 March and 30 September 2020: - A solicitor was involved in either drafting, witnessing or supervising th...e execution of the Will; - You intend, as the Will maker, for the document to take immediate effect as your latest valid Will; - You sign the Will in the [virtual] presence of witnesses by video conference; - The witnesses are able to (valid photo) identify you, the document you signed and the reasons that you were unable to sign your Will in the conventional way (being a government imposed or recommended, or self-imposed isolation or quarantine because of COVID-19). If your circumstances have significantly changed i.e. divorce, death of a loved one or beneficiary, disposal/ acquired significant assets or a change in your wishes, you should review your Will and update as necessary.
