25.01.2022 PROPOSED NEW POLICE POWERS IN RESPECT TO FIREARMS AND WEAPONS IN NSW The Hon Robert Borsak forwarded a copy of the Firearms and Weapon (Criminal use) Amendment ...Bill 2020 that is currently before Parliament to me late last week. It seeks to toughen up our already tough Firearms and Weapons laws with some further changes that are largely intended to protect us from a Police Officers imagination. It once again reminded me of Colonel TE Lawrence’s quote that: ‘’ All men dream: but not equally. Those who dream by night in the dusty recesses of their minds wake in the day to find that it was vanity: but the dreamers of the day are dangerous men, for they may act their dreams with open eyes, to make it possible''. My suspicion is that the Bill is a progression in the Police Forces desire to make life miserable for outlaw motor cycle gang members. Sadly however, many Police are not righteous in their activities (though most are), and I am sure, that, if passed, the law shall be used against gang members and shooters alike. FIRSTLY, PROPOSED CRIMINALISATION OF THE POSSESSION OF A FIREARMS PRECURSOR The law seeks to criminalise possession of a Firearms Precursor if possessed for the purpose of manufacturing a firearm (51J). A firearms precursor is defined as firearm precursor means any object, device, substance, material or document 32 used or capable of being used in the process of manufacturing a firearm or 33 firearm part, including (but not limited to) the following 34 1. (a) moulds for making firearm parts, 35 2. (b) milling, casting or rifling equipment, 36 3. (c) digital blueprints within the meaning of section 51F, 37 4. (d) computer software or plans. Firearms precursors’ would be found in many home garages, tool shops, businesses, men’s sheds, and in the tool room of most farms, and the only limit to prosecution would be the imagination of a Police officer seeking both ‘a result’, and to protect the community from his imagination. I have been a keen shooter since the age of nine, I am a keen shooter, hunter, student of arms- I used to fence and practice archery. I have a large library on firearms, Hunting, firearm law & criminality, forensics, military and firearms history, knives, archery and fencing, swords and swordsmanship. Amongst my electronic books is a book by Gerard Metral titled ‘The do it yourself sub machine gun’ that I down loaded from Kindle. I acquired the book because I wanted to ascertain, as a student of military firearms, how the Resistance in Eastern Europe were able to make most parts of a sub-machine gun, but found it more practical to have some components. (ie Sten Gun magazines air dropped to them by the RAF). The book outlines how to make a functional machine gun. The equipment he described is: A lathe big enough to turn longer parts (350 mm- 14 in A drill press A good heavy vice A vertical milling machine (helpful but not necessary) Tools to thread the body and plugs (it may be done on a lathe or with equipment for threading gas pipes) Welding sets (electrical or acetylene) A grinding machine Files, drills, taps, hacksaw and other basic hand tools. So, all of these tools are firearms precursors- see the problem! Of course, a single shot zip gun for use at very close range could be constructed with less tools- a metal tube, a rod, spring and level of ingenuity. I would not have the ability to make a machine gun, and if I were to try, the tools that I used would be more dangerous in hand, than any firearm I managed to produce, but I have a manual, and a typical garage would have at least half the items on that list and I own the book, so in the imagination of a copper, a gun nut like me is bound to be conspiring with one of his more mechanically able mates to make one. See the problem? My next thought is, where is the business case for this legislation- is it a bureaucrat’s imagination or is there a problem in Australia with people making firearms? This is not a poor country like Pakistan, the Philippines, or the Solomon island group, where a home-made illicit arms industry has arisen because people cannot afford the real thing. The legislation has references giving Police to seize and demand for example codes to access computers if they believe on reasonable grounds that they contain evidence of an offence. This is also dangerous, and there are no limitations. So for example in my case, a Policeman makes an allegation that I intend to make machine guns, and seizes my computer and demands access code to enable the sub machine gun book (‘Weapon precursor’) to be accessed. The legislation requires that I provide the code. They access a computer full of sensitive client information. There are no controls imposed upon what they can do with that information, although, it is hoped that a Court, dealing with improperly obtained evidence, may choose to exclude it, there are no guarantees there. Most criminals in Australia use real firearms, and a high capacity ‘wonder nine’ is viewed as a badge of rank or power, and with our effectively open border policy with only token checks, they are not hard to import. Interestingly, I have often asked in respect to prosecution whether a firearm has been registered in Australia- or is an illegal import. The authorities do not seem to care and just action all such matters, whether locally stolen or otherwise as ‘possession of an unlicensed firearm’. In almost thirty-five years of legal practice, I have seen many illicit arms in Court. All have been unregistered commercially manufactured firearms, although some have been in very poor condition, and have been tinkered with by the amateur (‘Bubba’d’). I am assuming that the idea of ‘precursor parts’ has come from elsewhere. In California for example, there is currently a bill (California Assembly Bill 2382) that defines as ‘Firearms Precursor’ part as a receiver, handgun frames, firearms barrels, finished slides, trigger groups. This is a more practical definitive range, but it is of no assistance to a busy and bothersome NSW bureaucrat with nothing better to do, because, these parts are already regulated here as ‘Firearms Parts’, hence their need to dream. Of course, most wars these days are fought with improvised weapons devices, ‘IED’s’, and most of the ingredients for such a bomb can be found under the sink in a typical kitchen, and others, via a five-minute hardware shop. Perhaps the legislators need to start licensing people who access domestic kitchens, and impose security restrictions to prevent unauthorised access. We already have problems with our gun laws being overly complex. Witness Hon David Elliot using weapons at a range during a visit, which I am sure he would not have done if he and those with him had known the law. I believe that he should be prosecuted for this because of the language of the law, and the Commissioner’s ‘’zero tolerance’’ edict, since nobody should stand above the law, and exercise of a discretion not to prosecute would render the process a sham. However, bureaucratic energy needs to be focussed upon simplifying laws whilst at the same time protecting public safety, and this is not necessarily achieved by making them more complex. PROPOSED FIREARMS PROHIBITION ORDER CHANGES As to the proposed Firearms Prohibition Order (‘FPO’) changes, they seem to be leading toward a system of 10-year review and roll over or orders, but the major concern is search powers of people who are with people subject to an FPO. Now, before you think ‘this does not apply to me’, think again: I presently act for a church going, professional who is a also a JP, in respect to a Law Enforcement Conduct Commission complaint, where, on my instructions, he innocently fell afoul of local Police. An FPO was issued by a Police Officer immediately before Taskforce Raptor performed a search, rendering what would on available evidence, otherwise have been an illegal search, since there was no probable cause for a search warrant issued by a Magistrate, a lawful one. His house was turned over by them- quite literally- every drawer was pulled out and up ended, beds stripped and up ended, clothes were pulled out of cupboards, carpet dirtied by Police jackboots in wet weather. Unless you have seen one, the only way one can conceptualise the outcome of a search like this is to picture the contents of a skip full of domestic items spread out over the ground. Nothing of significance was found, and nothing can describe the sense of violation this good family feel after being molested by a system that is out of control. Under these proposals, there would be nothing stopping Police from entering premises and searching he and his clients! Following dance party publicity, we all know the propensity for the NSW Police to snap on the latex gloves as a form of intimidation don’t we! Whilst I can acknowledge a need for Police to be able to search others on premises occupied by a person subject to an FPO- to prevent evidence, such as a handgun being handed to someone who is not subject to an FPO at the time of Police entry. there needs to be limits to this search power. For example, such a search should be limited to running a metal detector over a person to make sure they have not been handed a firearm however, the emptying of pockets or even cavity search without ‘probable cause’ S74A (2A) needs to be controlled. Sadly, we have a culture in the NSW Police Force, which is acknowledged by a Commissioner, that wants to be a ‘Force’ and to make people fear it. Once cannot, when faced with that sort of culture have empowering legislation permitting a Police Officer to act, if ‘they suspect on reasonable grounds’, without there being some consequence applicable directly against the Officer concerned, when the Officer does not act reasonably. A culture where Police simply pay compensation for misfeeds from consolidated revenue (ie our pocket) with Police simply considering that ‘the cost of doing business’ is clearly a cost that is too high for the community to have to pay, both monetarily, and in terms of basic loss of freedom. The Police are out of control in this state, and this needs to be stopped.

25.01.2022 The Queensland Government‘s decision to shut down all licensed firearm dealers and armorers without exception is ill-considered and puts the community at risk. ...Licensed Firearms Dealers must be deemed as an essential service and be authorised to continue to trade. Licensed Firearm Dealers are deemed essential service as: The security and safe storage of firearms, ammunition and explosives is essential to the safety of the nation. The Licensed Firearm Dealers network securely stores and controls the largest and most geographically diverse stock of firearms, ammunition and explosives in the nation. The operation of the National Firearms Agreement and the maintenance of the nation’s firearm registers is essential to the safety of the nation. The National Firearms Agreement 1996 [Australia’s Gun Laws] in respect to Licensed Firearm Dealers mandates that: Firearm sales be conducted only by or through Licensed Firearm Dealers. That Firearm Dealers are responsible for ensuring that purchasers are appropriately licensed. That Firearm Dealers record and maintain the details (of each weapon purchased or sold against the identity (name, address and license number) of the seller or purchaser. Firearm dealers provide records to the National Register of Firearms through the State and/or Territory licensing authority Firearm dealers provide records to assist police investigating crimes. Firearm Dealers are therefore essential to the continued operation of the National Firearm Agreement and the maintenance of the National Register of Firearms. The vetting of approved licenses and the mechanisms to ensure appropriate sale and transfer of firearms, ammunition and explosives is essential to the safety of the nation. The Licensed Firearm Dealer network performs this function for the Nation as prescribed under the NFA. The information security of licensed firearm owners including the address of firearm owners, their firearms and ammunition purchasing history, the location of their safe storage and the categories of firearms held on their license is essential to the safety of the nation. Licensed Firearm Dealers are required to record all firearm and ammunition transactions and verify licenses. As such, the network holds the largest collection of sensitive data outside of the nation’s policing network. Provision of safe storage for firearms for individuals that do not have adequate safe storage of their own or are not appropriately licensed to hold firearms is essential to the safety of the Nation. Licensed Firearm dealers provide a network to allow safe storage of firearms for individuals, who are unable to securely or legally store certain firearms, ammunition or explosives. These include, Defence Force personnel serving overseas, family heirlooms, people working in FIFO operations, deceased estates, unlicensed firearms found by individuals, previously licensed individuals, sick or temporarily disabled licensed individuals. Ongoing firearm amnesties are essential to the safety of our nation. The Federal Government, States and Territories have agreed to implement a permanent and ongoing National Firearms amnesty to be administered by the Licensed Firearm Dealers network. The licensed Firearm Dealers network is essential to the running of the national amnesty and cannot be allowed to fail. Mass business failures within the Licensed Firearm Dealers network would undermine the nation’s security by: Leaving the Nation’s largest stock of firearms, ammunition and explosives unsecured. Collapsing the National Firearms Agreement and the National register of Firearm’s by removing the mechanism to validate licenses, ensure appropriate transfer of firearms and ammunition, and recording and reporting of data to the National Register through the States and Territories. Exposing large volumes of data associated with individual firearm and ammunition purchase history, location of secure firearms storage for licensed firearm owners, identity details of firearm owners. Delivering a shopping list for organised crime both now and well into the future. Remove safe storage of firearm arrangements for 10’s of thousands of Australians in cities and towns across the nation. Diverting essential Policing resources [as many as 10,000 full time police nationwide] to manage the licensed firearms enterprise, secure and store 100’s of thousands of firearms spread throughout every corner of the nation, manage 100’s of millions of rounds of ammunition spread throughout every corner of the nation, manage large stocks of explosives (gun powder) spread throughout every corner of the nation, manage all transfers of firearms, registrations of parts, repairs to firearms and so on. Remove the ability for registered security providers involved in the protection of cash in transit or other armed guard duties to access firearms and ammunition for training or operational purposes. Animal Welfare and national food supply. In addition to national security considerations, the licensed firearm dealers network supports a range of other essential services including animal welfare, and protection of national food stocks. The collapse of the Licensed Firearm Dealers network would see farmers having to destroy stock with means such as hammers. Feral pest management to preserve the nation’s food stocks during what is hoped to be a productive winter crop period this year is essential. Licensed shooters are required to assist farmers in the control of feral pests which, if left unchecked, will destroy up to 30% of the nation’s crops. Urgent action required to secure the network: Western Australia and Queensland over the past 48 hours, without consultation or planning, have mandated the closure of this essential service. By tomorrow morning Monday March 30, 2020, if not addressed in those States: All licensed firearm dealership staff in those States will be stood down. Licensed firearms dealers will be walking away from their businesses and seeking alternate employment. Potentially not in their hometown. Dealers will not have the financial means to continue to provide security for large stocks of firearms, ammunition explosives at their registered premises. Individuals will be asked to collect their firearms from safe storage and take them to their local police stations. Local Police will be required to collect and safely store all firearms, firearm parts, ammunition and explosives at all dealerships. These will need to be insured and appropriately handled to enable safe return to the dealers if and when they are allowed to operate again. Frontline police resources will need to be diverted to handle transfers of firearms between individuals, acquire new replacement firearms and provide them to individuals, record details, update registers, verify licenses etc. Individuals with firearms will be directed into police shop fronts to address firearms issues surrendering, licensing or handing in for destruction of unregistered, unlicensed firearms ammunition and explosives. Firearms and ammunition currently in transit will remain in the general freight network and unable to be delivered for secure storage. Outlaw motorcycle gangs and organised crime will start looking for opportunities to exploit the close down. Expect increased targeting of failed dealership premises for theft of firearms, ammunition, explosives and personal details of individual licensed firearm owners addresses and firearms held. Also targeting of freight locations where the new goods cannot be delivered and must therefore be being stored.

12.01.2022 Letter to the Editor. Does the End, Justify the Means? Or Are Elections A Choice Between Two Evils? In any election where does one draw the line on who to vote ...for? Personally, for me, I believe in voting for the person whose philosophy advocates small government. In 2nd Treatise on Modern Government, John Locke points out ‘that political power is derived from the will of the individual, and that originally all individuals existed in a perfect state of freedom to order their actions, and dispose of their possessions, as they thought fit, without asking leave, or depending upon the will of any other man. The main reason why men (and wo men) enter into society, is the preservation of their lives & property; and to that end is why they chose and authorize a legislative, so that there may be laws made, and rules set, as guards and walls to defend the properties of all the members of that society. This is a limited power for it should never be supposed to be the will of that society, that the legislative should have a power to destroy that which every one designs to secure, for that is the main reason that people entered into society. That is why the people submitted themselves to legislators of their own free will. Whenever the legislators endeavour to take away, and destroy the property of the people, or to reduce them to slavery under arbitrary power, they put themselves into a state of war with the people, who are thereupon absolved from any farther obedience. Whensoever therefore the legislative shall transgress this fundamental rule of society; and either by ambition, fear, folly or corruption, endeavour to grasp for themselves, or put into the hands of any other, an absolute power over the lives, liberties, and estates of the people; by this breach of trust they forfeit the power the people had put into their hands for quite contrary ends, and it devolves to the people, who have a right to resume their original liberty, and, by the establishment of a new legislative, (such as they shall think fit) provide for their own safety and security, which is the end for which they are in society.’ Edited This was first printed in 1690 and this has been the concept that has guided Modern Government. During the 1940s much human life was sacrificed in defending the above concepts but during the latter part of the 20th Century creeping socialism has eroded the most important pillar of our society. Now our politicians are set as tin gods above us, they rate and tax, extort and steal to produce funds that supply swimming pools for some, large toy train sets for others, libraries, art galleries, football grounds, bowls, Christmas trees, that all buy them votes. Politicians are venerated as modern hero’s for supplying these benefits from those that cannot realise that those funds are extorted from other people’s property,‘money’ who cannot swim, who cannot afford a toy train trip, who don’t play football nor have time to visit libraries. Modern Society has gotten so used to the Pork Barrel trough of benefits it believe that it is their ‘right’, to support a local government that is given absolute power over our property. A small government would only concern itself with defending the property of its contributors with Lower Rates for Roads and Rubbish. Instead, our governments make financial slaves over us, to pay up, or we take your property. Yes, I have advocated that our Council assist the Cooloola Range Complex Association Inc obtain a rifle range in the Wood Rd Corella Foresty, but have never asked them for other people’s money. Mayor Mick Curren offered $2 million to find us somewhere else but that was just another Pork Barrel promise that no one believed. However, I do believe that it is very much within the above philosophy that Council should pay back to the 18000 licenced shooter in this region the rifle range, it took in 1992 and has since given to its own Cooloola Trail Care Alliance. 07.01.2022 Tonight I'm calling on Labor to reverse their decision to shut down and classify licensed weapons armourers and dealers as ‘non-essential services’. Farmers and... landholders rely on this industry to keep us fed. The LNP has written to the Premier and the Minister for Police and asked them to explain why these businesses were included as a non-essential service. It's imperative these businesses continue to operate to: 1 Continue to carry out servicing on firearms and firearm equipment to ensure safety standards are not jeopardised; 2 Provide a means for farmers to undertake their usual activities such as pest control; 3 Adhere to animal welfare standards in the event a firearm is required to humanely put down a sick or injured animal; 4 Allow for members of the public to surrender unregistered firearms (particularly for those found at a clean up of a property or at a deceased estate) to licensed dealers for safekeeping; 5 Provide lawful firearm owners the ability to access ammunition to control vermin as new crops continue to grow; and 6 Store firearms owned by members of the public who are required to surrender these under Domestic Violence Protection Orders. The decision to shut down these businesses also creates the situation where unsecured firearms will be sent to depots and remain there for up to 6 months. If this does occur, there is a real risk to community safety in the event proper safekeeping of these firearms is not adhered to. This decision will undoubtedly impact not only the licensed armourers and dealers but the farmers who are dependent on the industry. The Palaszczuk Labor Government needs to explain why it has singled-out licensed armourers and dealers from other industries which also provide essential goods and services to Queenslanders. The LNP is calling on the Palaszczuk Labor Government to overturn the decision immediately and work with the industry to put measures in place that can keep these businesses open but maintain social distancing.

04.01.2022 A BRIEF HISTORY OF THE GYMPIE SMALLBORE RIFLE CLUB By Eddie Powell Early information was gleaned from past founding members, Robert (Bob) Beard, John Cross, Pet...er Brady and from 1971 onward my own recollections. In the 1950’s, no exact date is known, a few local pigeon shooters were looking for a place where they could meet to zero their rifles. There was a rough patch of ground along the side of the then Full-bore Range with entry from Sandy Creek Road. In those days all rifle ranges and safety zones came under the authority of the Australian Army. Permission was gained and these few pigeon shooters had a safe place to meet and zero. After a while the regular shooters began a bit of a friendly rivalry and held competitive shoots between themselves. News got around and soon other shooters became interested in joining the fun. It was not long before it was decided to call it a club. Permission was sought and granted by the Army Administration Department and I am told that they had to have a nominal amount of members. I recall it was 20 or so. See more
