25.01.2022 A Family Violence Restraining Order (FVRO) is a type of restraining order that was introduced in Western Australia fairly recently on 1 July 2017. A FVRO is governed under the Restraining Orders Act 1997 (WA) which also offers Violence Restraining Orders (VRO) and Misconduct Restraining Orders to help victims of domestic violence, other violence and nuisance, obtain protection orders from the Court. You may consider applying to the Court for a FVRO against a family member if you need protection because of the risk of family violence. 23.01.2022 What is deemed as a sufficient fence when dealing with dividing fence disputes? According to the Dividing Fences Act 1961 (WA), a sufficient fence is: - a fence prescribed by a local government law as the minimum standard of fencing in that locality;... - a fence of any standard agreed upon by adjoining owners provided that it does not fall below the standard prescribed by the relevant local government law; - a sufficient fence that is ordinarily capable of resisting the trespass of cattle and sheep; or - a fence determined by a Magistrate in a Magistrates Court to be a sufficient fence. Please also note that a fence which corresponds with the last two points mentioned above is only a sufficient fence where no local law or agreement is made. 21.01.2022 In order to help combat the effects of the COVID-19 pandemic, the Australian Government had urgently introduced the Coronavirus Economic Response Package Omnibus Act 2020 to reduce the instances of companies being liquidated. The Coronavirus Economic Response Package Omnibus Act 2020 makes the following changes to the statutory demand process by: - Increasing the statutory minimum from $2,000 to $20,000; and - Extending the time for a company to respond to a statutory demand ...from 21 days to 6 months. However, the changes to the statutory demand system do not affect the ability of the creditor to pursue a company through the Courts to obtain a Court Order for the amount owing. If you have any queries about how this may affect your business or you yourself as an individual, please do not hesitate to talk to us at 08 6161 0243. We at AH2 Legal remain steadfast in helping you and will remain your trusted legal advisors during this period of uncertainty.
21.01.2022 If you are experiencing a downturn in business due to the COVID-19 pandemic, you might be able to request rent relief by providing your business records to your landlord or leasing agent. We at AH2 Legal are always ready to assist you with all your legal issues.
21.01.2022 When issuing a Parenting Order, the Family Court does not usually hear from children directly, although children can make their views known via a family report. This report is usually written by an independent family consultant with no ties to the parties involved and each parent may be interviewed with regards to what they think their childs wishes are when and if the need arises. Separation or a divorce is always hard and is a very stressful time for people. However, please remember that whatever happens, help is just a phone call away. Feel free to call one of our friendly lawyers at AH2 Legal at 08 6161 0243 for an initial free phone consultation.

20.01.2022 ? The Magistrates Court of WA can hear disputes relating to financial sums of up to $75,000. Recovery of sums larger than this are dealt with by higher Courts whereby the District Court of WA deals with claims from $75,000 to $750,000 and the Supreme Court of WA deals with claims from $750,000 onwards. Legal representation is allowed for claims of more than $10,000 in the Magistrates Court of WA. Claims of $10,000 or less can sometimes be started und...er a General Procedure Claim, but, in most cases, if you have a lawyer, you will have to pay for your own legal costs even if you win. If you happen to have loaned your money to someone and have trouble getting the money back, then please do not hesitate to contact us at 08 6161 0243 to discuss your options of getting back your hard-earned money.
20.01.2022 The costs of repairing a damaged dividing fence might be thousands of dollars. Hence, when it comes to dividing fence disputes - most people are rightly concerned about who should pay for the costs of repairing the damaged dividing fence. Generally, owners of adjoining land are each liable to pay half of the repairing costs even if one or both blocks are vacant. If you happen to face a dividing fence dispute with your neighbour, please do not hesitate to talk to us now at 08 6161 0243 for an obligation-free consultation.
19.01.2022 People may think that a financial agreement will fully protect their assets if a relationship or marriage fails, but this is not always the case. Parties must be very careful as financial agreements are not always legally binding due to them being improperly drafted as a number of recent court decisions in Australia have demonstrated. As such, a proper financial agreement must be drafted by a competent Family Lawyer in order to provide the best possible degree of protection of your assets. If you would like to know more about how a financial agreement can better protect your assets, please do not hesitate to contact us at 08 6161 0243 to discuss how we can help.
19.01.2022 If you are unable to pay your rent due to financial difficulties during the COVID-19 pandemic, then you should immediately check your respective lease agreements to see if there are any provisions for dealing with such a situation. Most commercial leases for businesses will have a provision for Guarantors and would stipulate that if the tenant is unable to make payment of rental to the landlord, that the Guarantor(s) would be responsible for payment and their obligations would kick in if the landlord chooses to enforce the particular provision. We do understand that everyone is suffering during this pandemic period. If you find yourself having any legal issues, please do not hesitate to talk to us at 08 6161 0243. We at AH2 Legal stand ready to assist you in this difficult time of uncertainty.

14.01.2022 Generally, when a person dies, their assets and liabilities will form part of their estate and pass to the person named as executor in their Will once probate is granted. The general rule is that your debt, whether it be a mortgage, private loans, credit card debt or car loans, will need to be paid back. Your estate (under the control of your executor) is therefore responsible for your debt after you die. If you are facing assets issues, please do not hesitate to call us now at 08 6161 0243 to find out how we can help.

06.01.2022 Before 1 July 2017 in Western Australia, a person who experienced violence from another person, whether or not they were related, could apply to the Magistrates Court for a protection order being a VRO. If the parties are not related such as having a relationship of colleagues, neighbours or friends - then a person who is experiencing acts of abuse can apply for a VRO.
