21.01.2022 If a beneficiary has been bequeathed an asset that was used to secure a debt and the beneficiary wants to retain that asset, then the beneficiary will usually bear the burden of the debt that is attached to the asset. The beneficiary must therefore repay or refinance the secured debt before the asset is transferred to them. If you are facing assets issues, please do not hesitate to call us now at 08 6161 0243 to find out how we can help.
20.01.2022 When issuing a Parenting Order, the Family Court does not usually hear from children directly, although children can make their views known via a family report. This report is usually written by an independent family consultant with no ties to the parties involved and each parent may be interviewed with regards to what they think their childs wishes are when and if the need arises. Separation or a divorce is always hard and is a very stressful time for people. However, please remember that whatever happens, help is just a phone call away. Feel free to call one of our friendly lawyers at AH2 Legal at 08 6161 0243 for an initial free phone consultation.
20.01.2022 Many people think that if you are owed money, then you must immediately issue a formal letter demanding payment from your debtor (the person or company that owes you money) and sue the debtor in Court. Whilst sending a letter of demand is often necessary, it can also make a dispute worse and damage a business relationship. Therefore, it is always advisable to firstly talk to the debtor that owes you money in a calm and civil manner to attempt in getting your money back before jumping the gun and proceeding with legal action immediately without trying to settle the matter out of Court. If you have any legal questions regarding to your debt collection, please do not hesitate to contact us at 08 6161 0243.

18.01.2022 Before 1 July 2017 in Western Australia, a person who experienced violence from another person, whether or not they were related, could apply to the Magistrates Court for a protection order being a VRO. That is no longer the case. If a person experiences acts of abuse by a family member then that person can now apply for a FVRO. If the parties are not related such as having a relationship of colleagues, neighbours or friends - then a person who is experiencing acts of abuse can apply for a VRO. Essentially, FVROs are reserved for family members or parties that are related in a family context. If you are facing any abuse (be it in the form of mental or physical abuse) by someone, please do not hesitate to call us now at 08 6161 0243 to find out how we can help.
