25.01.2022 For those who are planning to start a business: Difference between Legal name, Business name and Trade Mark: 1- Legal name is the name of the person or entity that owns that business. Like Peter Black or surnames of partners in partnership. 2- Business name is a name under which your business operates and you should register with ASIC if it is not your own name and later you should conect it with your ABN.... Business name doesn't give you legal rights to that name which means you don't have any rights to stop someone else from using your business name. You cannot register a business name which is identical or similar to the other registered name. 3- Trade Mark: A Trade Mark can be a logo, your Business name, Word, Number, Shape,Sound, Picture ..... A registered Trade Mark can provide legal protection and enable you to stop others trading with it whichmeans it gives you exclusive rights to use it throughout Australia. Minimum time reqiured to process the application for registeration would be about 8 month. A Trade Mark registeration is for a period of 10 years in Australia and can be renew after that. For protection in international level, you should register your trade mark in the country you need protection. See more
