07.01.2022 Supreme Court result, 26th June 2019: Richard King v Ombudsman SA and Trevor Adamson The Court today dismissed APY general manager Richard Kings application.... Unsurprisingly, there was no fraud found against our side. King had alleged fraud was committed by Mr Brouss Ngunanti Chambers in assisting and representing Mr Trevor Adamson who had - with very good reason - lodged statutory complaints against Richard King. During both the 4th and 17th December 2018 hearings of this case Justice Kelly had repeatedly criticised King for bringing such accusations against Mr Chambers to the Court. We won this case, and very convincingly. This judgement removes obstacles for Richard King to be investigated by relevant oversight agencies. Cost to be argued on 18th July. # Still to come is the result from the 25th January 2018 hearing where Richard King had caused APY to sue Ombudsman SA and a Member of Parliament. That action claimed APY is not subject to the Freedom Of Information Act. A similar result to todays decision is expected soon from that Court. 05.01.2022 PRESS RELEASE - 8th July 2019 In a shocking episode Richard King (King) and Rex Tjami (Tjami) published on APY social media a press release on 4th July 2019... which falsely represents the content and in effect the decision of Justice Patricia Kelly in the case of Richard King v Ombudsman SA and Trevor Adamson SCCIV 590-2018 delivered on 26th June 2019 (judgment). The apparent motivation is to create the impression that the judgment is the unjust outcome of a case brought by APY for justice for Anangu fighting interference from the court, the Ombudsman SA and third parties, in Anangu business. This is rumour control and here are the facts: 1. The judgment was made in a case filed by Richard King personally and in his own name - not APYs. APY Inc. was not a party to, nor was it involved in the case at all. King as a natural person sued the Ombudsman and Trevor Adamson. 2. King / Tjami have criticised Justice Kelly and wrongly accused her of producing a judgment allowing interference in Anangu affairs. This is false and may amount to a contempt of court. 3. King / Tjami also attack the Ombudsman, who is accused of interference. This is false. The Ombudsman has - by State Law under an Act of Parliament - a power and a duty to investigate statutory officers such as King on complaints that King had acted wrongly in public administration. End of discussion. King systemically fails to comply with State Law under acts of Parliament and uses APY funds to start court cases, which he uses as an excuse not to comply with State Law. 4. King again attacks Mr Brouss Ngunanti Chambers accusing him of interference and of making a complaint to the Ombudsman. This is false. Justice Kellys judgment expressly dismisses all of Kings serious allegations of fraud against Mr Chambers - and in fact goes to some lengths to point out that there was never any evidence to support the bringing of those allegations. 5. The judge went to the trouble of annexing to the judgment a paragraph-by-paragraph summary of why she rejected Kings allegations about Mr Chambers - thus nobody will have to go leafing through a transcript to find reference to Kings evidence, that it was struck out, and why it was struck out. Clearly the judge has done this for a reason. Incredibly despite the judge striking out the evidence, Kings lawyers went on and made submissions against Mr Chambers anyway. This raises serious professional conduct issues and Mr Adamson has taken or is taking steps. 6. Kings lawyers - acting for King and not acting for APY - brought this case and lost the case on each and every point. WHAT THE CASE IS ABOUT 7. What the case is about is set out in the judgment. King obstructed Trevor Adamsons chairmanship of the APY Executive board (board) from the commencement of his chairmanship in June 2016 and refused to provide Trevor with copies of handwritten notes to Trevors email address, and carried out other misconduct against Trevor who then complained to the Ombudsman. Ombudsman made findings of wrongdoing against King and additional findings that King failed to co-operate with his investigation. The Ombudsman recommended that King apologise to Trevor and found that Kings actions destroyed trust with some members of the board. 8. King did not apologise to Trevor and ignored the Ombudsmans report. 9. The judgment specifically rules that the complaints about the 27th March 2017 Special General Meeting (SGM) and 23rd June 2017 Special Executive Meeting (SEM) were brought by Mr Adamson, not by Mr Chambers. 10. King claimed to have a barristers opinion that these meetings were invalid - however King refused to say why. The Ombudsman asked King to provide the instructions given to the barrister to provide the advice (the instructions enquiry). It was then that King launched this case, which case caused the instructions enquiry to be held in abeyance until the judgment was delivered, thus in practical terms providing King a shield from that enquiry behind which shield King persuaded a new three year employment contract.. APPEAL 11. As APY Inc. was not a party to the case APY can not appeal and has no right of appeal. Any appeal must be made by King personally. COSTS 12. The comments about costs creates the false impression that this case involved or relates to APY and that the judgment is somehow adverse APY and or to Anangu interests regarding costs. These comments also strongly suggest that that APYs funds have been used to pay Kings personal legal costs, and that it is intended that APY funds be used to mount an appeal by King. 13. Nevertheless King has lashed out and told the world that APY will be paying only one set of costs, not the costs of the Ombudsman and of Trevor Adamson, and that costs will be delayed until the end of an appeal. 14. King bought the case as plaintiff and as the losing party is required by the normal rules to pay the costs of the other parties. All questions of costs are for Justice Kelly to decide. The judge will rule on questions of costs. Kings public comments about costs yet to be determined by the court may constitute contempt of court. CRIMINAL LAW CONSOLIDATION ACT 15. King and APY Director of Administration Mr Rex Tjami are both public statutory officers. Apart from any question of contempt of court their actions in publishing this release have to be viewed through the lens of improper conduct and abuse of office within sections 238 and 251 respectively of the Criminal Law Consolidation Act. Other statutory officers such as Executive board members are bound by the Criminal law Consolidation Act have a duty to report to the Independent Commissioner Against Corruption (ICAC - OPI) any conduct which they reasonably suspect may constitute mal-administration, misconduct, or corruption in public administration. INDEPENDENT ADVICE 16. Plainly the board needs independent advice about the judgment independent of King, Tjami and Kings lawyers. 04.01.2022 Bonos message: John The Baptist Smith My first sense of John The Baptist Smith was observing cassettes of his preaching being passed around like he was some ki...nd of obscure indie rock band, which in so many ways he kind of was. But he had hits - John GOT pop culture. On one cassette he was uncovering the (William) Blakean influence on Kris Kristofferson, on another his exegesis was on Bette Midlers movie The Rose - which he opened up like it was a missing Gospel. On another he broke down talking about an outlaw biker called Ball Bearing whose deep knowledge of the blues had opened Johns own mind to the possibility of Psalms hiding in the form: the brutal honesty of the blues made sense to John and made sense of John. John Smith was the only one NOT surprised to hear the Hells Angel jam Where Were You When They Crucified My Lord? John quite liked that some churchy people thought of him as a heretic: Big smile across his face. You mean like Jesus matey? To John the Bible was an incendiary tract - not some handbook on religion. It was not a sop for mankinds fear of death - it was an epic poem about life. It spoke about culture, about politics, about justice. Yeah so heres to you, John the Baptist Smith, a voice crying in the wilderness. Let the valleys be raised and the mountains laid low. Make way for the coming of the Lord and make it flat as a freeway please - with no speed limit if possible. Yeah let the pilgrims know Jesus will take the back seat - but if ye want the ride of your life give Him the handles and hold on tight. When Bob Dylan sang, always on the other side of whatever side there was he might have been singing about John: an outsider in an outsider community, an outlaw of a different kind preparing the way for the coming of different kind of world .. speaking truth to power. It didnt matter who you were; didnt matter if he was your guest.. In our last meeting he spoke truth to me, gave me a hell of a hard time, thought I had gone soft and become too comfortable around the powerful. Thought I was living too well. He was probably right. I still think about it. I hope the Archangel Michael is not wearing Gucci loafers, hell be getting it in the neck from our John the Baptist Smith if he is.. - Bono.
