19.01.2022 When was the last time you objectively looked around your property and considered the risk of harm to guests, workers or anyone else coming on site? Who is responsible when a guest trips over? A recent court decision found that an occupier (in this case a hotel) is entitled to assume that an entrant will take reasonable care for their own safety. However the court also stated that an occupier must consider that entrants might become distracted, inattentive or be less than ca...reful when identifying foreseeable risks of harm. A court will take these competing considerations into account in determining whether or not a duty of care has been breached. Just because a risk of harm is considered obvious, it doesn’t obviate the liability owed. In this case, the hotel was found to have breached its duty by failing to take precautions.
