18.01.2022 Exploitation of trolley collectors has been an ongoing focus for us. It’s a low-skilled, low-paying job where we often find vulnerable workers who are unsure of... their workplace rights. In our latest court case, a Judge has handed down $230,000 in penalties against a trolley collection subcontractor for exploiting two vulnerable migrant workers and then using false records to try to cover it up. The workers were underpaid a total of $29,031 and have been back-paid in full since we completed our investigation and began legal action. The workers were being paid hourly rates ranging from $9.73 to $19.32 and were underpaid: minimum hourly rates shift-work loadings overtime rates penalty rates for work on weekends and public holidays superannuation annual leave entitlements. The workers asked for our help during our inquiry into the procurement of trolley collection services, which involved Fair Work Inspectors visiting 130 sites across Australia. Both workers had recently arrived as refugees and been granted permanent residency, and had limited English language skills. As a general rule of thumb, if you’re full-time or part-time the minimum noti...ce you need to get will depend on how long you’ve been employed: 1 year or less = 1 week More than 1 year to 3 years = 2 weeks More than 3 years to 5 years = 3 weeks More than 5 years = 4 weeks. You get an extra week of notice if you’re over 45 years old and have worked for the employer for at least 2 years. Remember, an award, contract or enterprise agreement can set longer notice periods than the above (e.g. 1 month instead of 1 week). And the notice you’re required to give when resigning might also be different.
