18.01.2022 Ending Regulation of Migration Practice Will Reduce Protection for Consumers The Migration Institute of Australia (MIA) is disappointed by the recommendation of the Senate Legal and Constitutional Affairs Legislation Committee that the Migration Amendment (Regulation of Migration Agents) Bill 2019 be passed without delay. The MIA National President, John Hourigan FMIA, welcomed The Greens dissenting report and recognition of the need for accountability for lawyers providing m...igration advice. If this bill is passed it will permit all and any lawyers to practice migration law, many of whom have never even covered a migration law subject in their entire law degree. While the Law Council of Australia claims that dual regulation leads to confusion for consumers over the differences between immigration lawyers and registered migration agents, the MIA contends that the removal of the common registration of both professions, leaves consumers without any means to clearly distinguish between those legally able to provide migration advice and those rogue illegal operators who prey on vulnerable consumers. The MIA is also concerned that a number of lawyers who been banned by the regulatory body from practising as registered migration agents because of fraudulent activities, will now again be able to practice without restraint in the migration law sector due to this removal of regulation over migration agent lawyers. While the bill might satisfy the professional pride of some in the legal profession, the level of protection and quality assurance for consumers of migration advice will be decreased. The MIA calls on the Senate to carefully consider the contents of this bill when it is presented for further debate. Passing this bill will increase the confusion and cost to consumers seeking migration advice and should be strongly opposed.
