13.01.2022 Criminal Law Fact #1 In criminal law, the job is to evaluate the evidence. The Queensland Police Service Operational Procedures Manual ("OPM") 3.4.3 outlines the Sufficiency of Evidence Test.... This test must be used by Police Officer when deciding to charge a suspect and will only be satisfied if there is enough admissible evidence to prove the charge against the defendant. A prima facie case ('On its first encounter') is essential but is not enough. There must be a reasonable prospect of the defendant being found guilty of the offence. A detailed evaluation of how strong the case will be when presented in court should be undertaken as part of this test. In evaluating the sufficiency of the evidence, it is necessary to consider all aspects of the evidence to be presented. At times, Police must act quickly and are under all sorts of pressures (at times, even from Management) to charge a suspect, which results in many errors being made in evaluating whether there is enough evidence to proceed. That is why it is vitally important to have an experienced criminal lawyer look over all the evidence at the Case Conferencing stage (the very early stages of your matter before a Plea is entered) and see if there are any errors in the evidence or Police procedures. Time and time again, I see errors in Police procedures and have matters dropped after submissions have been drafted to the Prosecution highlighting the errors. Police procedures, like those outlined in the Police Powers and Responsibilities Regulation, are there for a reason.
