19.01.2022 https://www.hocw.com.au//sexual-harassment-policies-proce/ Unfortunately, workplace sexual harassment is again in the spotlight. As a result, many employers may be wondering whether their sexual harassment policies, systems and procedures are up to standard. Employers that do not maintain up-to-date policies, fail to provide the appropriate training and support, and bungle the management of complaints, risk not complying with their duty to provide a safe workplace for their employees. The effects of sexual harassment can be devastating on individuals and these effects can be exacerbated by a sub-standard, poorly handled or unnecessarily drawn out investigation following a complaint.

17.01.2022 We are delighted to announce Natalie Talia, Senior Associate, is now a Law Institute of Victoria Accredited Specialist in Wills & Estates, and James Francis, Senior Associate, a Law Institute of Victoria Accredited Specialist in Workplace Relations. We congratulate both Natalie and James on their fantastic achievements, especially with the challenges that this year has brought. Well done Natalie and James, what a great way to finish the year.

12.01.2022 https://www.hocw.com.au//covid-19-jobkeeper-benefits-upda/ JobKeeper has been a lifeline to businesses that otherwise would have struggled through the restrictions imposed by the Federal and State governments. In light of the ongoing nature of the pandemic, the JobKeeper payment has been extended beyond its original 28 September 2020 sunset date, albeit with some modifications.

10.01.2022 https://www.hocw.com.au//owners-corporation-act-changes-a/ The Owners Corporations and Other Acts Amendment Act 2021 (the Act) was passed last month. The Act will come into operation by default on 1 December 2021, if not proclaimed earlier. In essence, the Act not only includes additional protections for lot owners but imposes more stringent obligations and restrictions on owners corporation managers and developers.

09.01.2022 https://www.hocw.com.au//landlords-and-tenants-six-change/ Attention landlords and tenants - substantial changes have been made to the Victorian Retail Leasing Legislation. Note that six of the main changes involve ESMs, the landlord’s obligation to provide the tenant with a disclosure statement and the copy of the proposed lease, return of security deposits, option notices, market rent reviews on renewal of lease and cooling off.

02.01.2022 Last year, the Full Court of the Federal Court of Australia handed down a landmark judgment in the case of Mondelez v AMWU confirming that all full-time and part-time employees were entitled to 10 days of personal leave per year, in accordance with its interpretation of section 96(1) of the Fair Work Act 2009 (Cth) (the Act). This judgment had the effect that no matter what hours an employee worked, they would be entitled to ten days of leave.
