21.01.2022 A reminder to clients that a stamp duty waiver of 50% is available for purchases of new Victorian residential properties and 25% for existing residential properties and vacant land. To be eligible for the waiver, purchasers must satisfy the following conditions: 1) you must purchase residential property, whether or not you use it as your principal place of residence;... 2) the property must have a dutiable value of $1 million or less; 3) the contract must be signed on or after 25 November 2020 and before 1 July 2021; and 4) the arrangement must be a bona fide purchase for adequate consideration (i.e. the property must not have been gifted to you). 16.01.2022 We were so happy to read this heartwarming article about one of our dearest clients, Mrs Buck, who has been reunited with her family after weeks of seperation due to coronavirus restrictions at her residential aged care facility. Mrs Buck was one of our very first clients when we started Highlands Lawyers almost three-and-a-half years ago and her family comprised of 3 generations at the time. 12.01.2022 An important notice from the State Revenue Office of Victoria about the valuation of property for stamp duty purposes. You may be required to provide evidence of the value of your property when: i) you are given property as a gift;... ii) you purchase property from a friend, an associated person or an associated entity; iii) you purchase property at a discounted price or for some form of non-monetary consideration; iv) you purchase property that involves a fractional interest; v) you purchase property in connection with a business for a total sum of more than $1 million; and vi) the purchase price of your property is equal to or less than the property’s current capital improved value for rating purposes. The Commissioner is prepared to receive a letter of appraisal by a licensed real estate agent as evidence of the value of a property. However, additional information or a formal valuation may be required. If you are required to provide a formal valuation, you must engage a qualified valuer (i.e. a person certified or accredited by the Australian Property Institute) to prepare the valuation.
