22.01.2022 Domestic violence: NSW Government introduces new strangulation laws The NSW government has proposed new laws to deal with domestic violence. Some of the proposals include allowing women to apply for indefinite apprehended domestic violence orders in the most severe cases. Furthermore, the NSW government has also requested amendments to strangulation offences to only require proof of intention of choking, strangling or suffocating without consent. Of course, a person would never be able to pursue their own probate application (since they are the deceased)- and it would be a task for your Executor and Solicitor to oversee the process. Fast forwarding to this moment, it's been the best thing that happened to us; a bell curve of learning. Equal amounts of laughter and tears -sometimes from our clients, and sometimes from our peers. Overall, a rollercoaster of a year; one we don't plan on getting off anytime soon.... Happy anniversary to us

15.01.2022 Last week Tasnim and Sarwa attended the Symposium on the Agency of Muslim Women in the Australian Context hosted by The University of Sydney and The University of Melbourne's Law schools. Tasnim and Sarwa presented a paper on Muslim Women and Family Law; how The agency of Muslim women in such processes (Family Law) is a compromised one, due to power imbalances, socio-economic issues, education and predominately male-only community dispute resolution bodies. It was a pleasur...e to be among the many women who have contributed to the growing understanding of how we're navigating women's agency in the Family Law system. No insurance duty on lenders mortgage insurance Unfortunately Contracts dated prior to the commencement of these reforms will not be entitled to the new changes. 14.01.2022 Autopsies and Wills. Most clients specifically request that no autopsy be performed on their body post death. While this request can of course be disregarded if the Coroner orders a post mortem be conducted, what most people don't know is that an autopsy can be objected to by the next of kin. ... The next of kin must: 1. Write a letter stating their objection and must include the reasons why they are objecting to the examination, including any cultural, religious or personal beliefs they wish the Coroner to consider. 2. The letter should be urgently emailed to [email protected] or faxed to the court on (02) 9660-7594 with the subject heading on the email as 'OBJECTION TO POST MORTEM". 3. If the objection is rejected, the next of kin can apply to the Supreme Court for an order that no post mortem be performed. Point is- if the deceased specifically has a will requesting that an autopsy not be conducted, it is the family member's responsibility to do their best to ensure that the deceased's wishes are at least considered.

09.01.2022 A NEW road rule has been introduced in September 2018 in New South Wales. The new law is designed to protect emergency service workers when they are stopped on the side of the road. Drivers must slow to 40km/h when passing stationary emergency vehicles which includes police cars, fire engines and ambulances displaying red and blue flashing lights.... Ignore the new rule at your peril the fine is $448 and the offence earns three demerit points. 02.01.2022 A short for your information on something quite important. We often get asked by clients what the difference between a Will and Power of Attorney (PoA) is? In brief: 1. A PoA is effective during the lifetime of the person giving the authority. It ceases upon death. There are two types of PoA:... a) General power of Attorney- this type is commonly used by individuals who are perhaps travelling and wish to appoint an attorney to look after their legal and financial affairs while they are away. This authority automatically terminates if the person giving the authority loses mental capacity; b) Enduring PoA- An enduring power of attorney continues to operate even after the principal has lost mental capacity. By making an enduring power of attorney, there will be someone who can legally look after your legal and financial affairs if you become unable to do so and the advantage of making an enduring power of attorney is that you can choose the person who you want to be your attorney. 2. A Will is effective once a person dies. It is a legal document that stipulates how your estate will be distributed, who will distribute it and who will benefit from it. From experience, we believe both a PoA and a Will are just as important as eachother particular for those heading towards old age or experiencing health issues.
02.01.2022 RECENT CHANGES - 1 JULY 2018 GET SET FOR A 3.5% WAGE INCREASE !!!!!!!! The Fair Work Commission has announced a 3.5% increase to minimum wages. The increase applies from the first full pay period starting on or after 1 July 2018. The new national minimum wage will be $719.20 per week or $18.93 per hour. The national minimum wage applies to employees who arent covered by an award or agreement. For employees covered by an award, award rates will increase by 3.5%.... Remember, there will be further changes to Sunday penalty rates in some hospitality and retail awards from 1 July 2018, following a decision from the Fair Work Commission last year.
