25.01.2022 TASMANIA-RECENT CHANGES FOR APPLICANTS AFFECTED BY S48 AND CORONAVIRUS TRAVEL BAN In support for visa state nomination a Subclass 491 applicant who holds a Bridging Visa A, B, C or E while seeking review of a decision would be required to depart Australia in order to lodge their visa application with the Department of Home Affairs. While travel restrictions are in place many applicants will find it difficult to depart Australia and all will be unable to enter Australia (unle...ss exempt). In an effort to manage this situation, as of 2 April 2020 all applications on hand and lodged thereafter by candidates who hold a Bridging Visa associated with Administrative Appeal Tribunal (AAT) or Federal Court review will continue to be assessed as normal. Unsuccessful applicants will be advised of the outcome and should not reapply until travel restrictions are lifted. 25.01.2022 NSW 491 NOMINATION OPEN DATE and 188/132 VISAS RE-OPEN DATE NSW 491 Nomination Mr Zane Rebronja - Associate Director, NSW Business and Skilled Migration - NSW Treasury, in the recent Migration Agents session, expressed that the open date for NSW 491 likely in the new financial year which means it is on or after 1 July.... The delay of commencement was due to NSW bushfires and COVID19, there have been some major pushbacks in relation to the 491 visa being rolled out in NSW. The NSW skilled occupation list will remain more or less the same, certain occupations may be added or removed as it continues to assess the damage caused by COVID19. 132/188 Nomination He also expressed that that both subclasses 132/188 hopefully will re-open on 1 July 2020 however there is no guarantee in relation to the exact date or the number of places available as the final number of places allocated for next financial year will be determined by Home Affairs. In most cases the numbers asked by NSW align with the numbers allocated by DHA which is good news, for this year however the programme allocation is exhausted. It is unlikely that there will be any major changes to 132/188 visa programmes, it is encouraged to check with NSW State site for the most update information. 23.01.2022 RECENT CHANGES IN WESTERN AUSTRALIA STATE NOMINATION You can see there are some new conditions/requirements for some individual occupations under the WAs nominated skilled list, "Regional WA only" or "under Review" as a result of recent changes. "Regional WA only"... Candidates nominating for occupations that are designated Regional Western Australia only in the General or Graduate stream must provide evidence of a job offer/contract of employment in a location defined by the Commonwealth as Category 3 - Regional Centres and Other Regional Areas (not Perth and Mandurah). These include the following areas by postcodes: 6041 to 6044, 6084, 6207, 6213, 6215 to 6537, and 6560 to 6770. It applies to both SC190 and SC491 applicants. "Under Review" Candidates nominating for occupations that are designated Under Review in the General or Graduate stream means the occupations are under review by the State at the moment, which results only a few invitations issued for those occupations, you may not be invited to apply for State nomination.

21.01.2022 QUEENSLAND STOPS NOMINATE S48 BARRED APPLICANTS If an applicant is currently on a bridging visa and has been invited to lodge documents with BSMQ for a subclass 491 visa, they must notify Business and Skilled Migration Queensland of any past visa refusals or cancellations. If an applicant has received a visa refusal or cancellation whilst on a bridging visa they are likely to be subject to a section 48 bar which means they are unable to lodge a state nominated visa (and mos...t other visas) onshore. Unfortunately during the COVID-19 pandemic, it not possible to go offshore to lodge a visa application, and then return to Australia. This is because there is an entry ban on temporary visa holders returning to Australia at this time. If you or your client is section 48 barred, BSMQ is unable to nominate for a subclass s491 visa and request that the application be withdrawn. 18.01.2022 SC485 TEMPORARY GRADUATE VISA AND STUDENT VISA SPECIAL ARRANGEMENT DURING COVID-19 TEMPORARY GRADUATE (Subclass 485) visa eligibility Department of Home Affairs has changed the requirements for a Temporary Graduate (subclass 485) visa for those who have been impacted by COVID-19:... -Online study undertaken outside Australia as a result of COVID-19 travel restrictions will count towards the Australian Study Requirement for existing and new student visa holders THIS CHANGE IS AVAILABLE NOW. -Graduates affected by COVID-19 travel restrictions will be able to apply for and be granted a Temporary Graduate visa outside Australia (where they have met all the requirements). THIS CHANGE IS NOT AVAILABLE YET. STUDENT VISA FEE WAIVE The Student visa application fee will be waived to allow you to lodge a further student visa application to complete the study. This will be available to students who held a student visa on or after 1 February 2020 and who couldnt complete their course within their original visa validity due to the impacts of COVID-19. To be eligible to have your application for fee waiver considered, you must apply for a Student visa after midnight AEST 5 August 2020 and you must attach a completed Form 1545 COVID-19 Impacted Student (PDF - 228 KB) from your education provider with a valid Student visa application. You must apply for this visa online. You can be in or outside Australia when you apply. Refunds will not be available for students who have already applied for a Student visa. 17.01.2022 BREAKING NEW: WESTERN AUSTRALIA CHANGES TO GRADUATE STREAM OF STATE NOMINATION MIGRATION PROGRAM -The State Nomination Migration Program (SNMP) Graduate stream will soon be more accessible for international students who study in Western Australia. On 16 October 2019 Premier Mark McGowan announced that the Graduate Stream of the SNMP will be extended to include vocational education and training (VET) graduates who complete a qualification in Western Australia at Certificate ...III level or above, excluding trade occupations (unless approved for delivery to international students). The first invitation round to include VET graduates will be issued in December 2019. Other changes to the SNMP Graduate stream are: - studies in Higher Education, VET and/or English Language Intensive Courses for Overseas Students (ELICOS) will all count towards the requirement to study for two years in Western Australia. - work experience and job offer requirements will also be reduced. Graduates will need to either demonstrate six months of work experience or a six month employment contract, but not both. 15.01.2022 Unable to claim points of Professional Year for ICT and Engineering occupations if the first 4 digits of the ANZSCO codes of the occupation are not the same as the first 4 digits codes of their professional graduates. A private reply from the Department of Immigration revealed that Professional Year points can only be awarded to closely related occupation within the same 4-digit unit group. For example: Accounting graduates of Accountant(General):221111 is fine to claim the p...oints, but external auditor is 221213, so 2212 is different to 2211 and hence the external auditor applicants cannot claim the points of Professional Year. Which 4 digits codes of ICT and Engineering occupations can claim the Professional Year points are yet to confirmed.
