20.01.2022 What is a Power of Attorney? A person who is given the legal authority to make decisions on your behalf regarding your financial affairs (e.g. banking, centrelink, selling your house etc). This power can occur when you want it to occur - e.g. straight away, while you are overseas or in quarantine, when you are unable to make the decisions yourself. What is an Enduring Power of Attorney? Same as a Power of Attorney but only comes into effect when you have lost your mental c...apacity to make such decisions for yourself (e.g. dementia, coma etc). What happens if you do not have one? If your loved one or family member needs to make a decision regarding your financial affairs when you are unable to, they will not be able to do anything with third parties (e.g. access bank accounts or sell your house). They would have to obtain authority from Tribunal and if this is disputed or if it is found that they are unfit to be your Attorney, the NSW Trustee and Guardian may be appointed to act as your attorney. Trustee and Guardian charge you for their services.

As a firm, we had a number of internal meetings where we all discussed how important it was for us to keep servicing our clients to the best of our ability, pandemic or no pandemic. I picked up the phone whenever I could to talk to clients and took on an advisory role for a lot of our business clients who were - and are dealing with the economic effects of the pandemic. Our whol...e firm moved to working remotely and we have fortnightly staff meetings, where we all catch up and socialise, to add normalcy to our working lives. Whats a good thing about Working From Home? It is relatively relaxed workwear around my place and the commute from place of rest to place of work is about 2 metres, so I save on transport costs! The only wait time these days that I have is the line for the coffee machine in the kitchen but I can usually push my cat out of the way and get there first. Coffee remains a priority! New skills learnt during ISO? I have improved my drawing skills to a level likely paralleled elsewhere but it is still quite, I must say, very impressive. 09.01.2022 CHANGE IN LAW FOR CASUAL WORKERS The Federal Court has handed down its judgement in the matter of WorkPac Pty Ltd v Rossato [2020] FCAFC 84 that regardless of any agreements between an employer and a casual employee, if a casual employee has a regular pattern of work, pre determined hours and patterns and/or continuity of work with the employer (among other factors), the casual worker is deemed a permanent employee. Once deemed a permanent employee, they are entitled to annu...al leave and sick leave entitlements as any full time or part time staff. The Court goes further to not allow the employer to offset any payment of entitlements against any amount paid to the employee (including casual loading). This is a landmark decision that, given the current climate for businesses, will cause more uncertainty.

08.01.2022 On 16 March 2020, all Jury trials were suspended until further notice due to COVID-19. From 15 June 2020, The District Court of NSW intends to lift the temporary suspension of jury trials in some, but not all venues. Jurors will be able to safely socially distance with new stringent requirements, however this means that there will be limited number of Court rooms available for Jury Trials in Sydney, Parramatta and Newcastle District Court.

When should you get an Enduring Guardianship? As soon as possible. You never know what can happen tomorrow and so you should always be prepared. The Guardianship does not come into effect until you lose your mental capacity.

Earlier this year, the NSW government passed a law that: - Encourages good faith negotiations between a landlord and the tenant. - Stops the landlord from taking enforcement action against the tenant to terminate the lease, call on a bank guarantee or pursue a guarantor. ... - Stops your rent from being increased during this period but rather renegotiations should take place with the impacts of COVID-19 in mind. This might mean proportionate reductions in rental payments may be negotiated. With this in mind, legal assistance is recommended to make sense of these new laws and the possible effects to individual leases.
