04.01.2022 Have you had your payments terminated because the insurer thinks you can do an unrealistic job? WorkCover can not simply terminate your payments by speculating about your ability to undertake 'suitable' employment. A worker had his payments terminated after 130 weeks on the ground he had a work capacity. The Medical Panel agreed. This was overturned by the Supreme Court on appeal as the Panel and the WorkCover Independent Medical Examiner did not provide a path of reasoning ...as to why the proposed jobs were suitable. A helpful case for workers.
