An employee: - Performs the work.... - Uses the company’s equipment to perform the role. - Is directed by the employer in performing the work. - Is paid on the basis of an agreed hourly rate, wage or award. - Tax and superannuation is paid on behalf of the employee by the employer. - The employee operates as part of the business. In comparison, a contractor: - May contract someone else to do the work. - Uses their own equipment to perform the role. - Is not directed by the employer, but makes decisions based on their own skill. - Is paid on the basis of the activity or time or for a predetermined outcome. - Pays their own tax, superannuation. - Is responsible for the legal risk in performing the role, having to remedy any works at its cost.
