25.01.2022 Do you have casual employees? A new Federal Court decision has likely affected you. If your casual contracts state that a casual loading (normally 25%) has been applied to offset an entitlements to annual and personal leave, public holidays etc then this decision affects YOU!... The latest decision from the Federal Court has again found that a casual employee who received a 25% loading on their hourly rate is entitled to back pay of annual leave, personal leave, compassionate leave and public holiday pay - for 3.5 years. In light of this latest decision, we will be reviewing the contracts and employment relationships for all our clients. 22.01.2022 Award Wage Increase The Fair Work Commission today has issued its decision to increase the national minimum wage by 1.75% to $753.80. This will be effective as of 1 July 2020. However, the FWC has determined different operative dates for increases to other modern awards. ... Group 1 awards will have an increase effective 1 July 2020 Group 2 awards will have an increase effective 1 November 2020 Group 3 awards will have an increase effective 1 February 2021. Group 1 will cover industries less affected by COVID-19 and will include front line health care, teachers, childcare, social workers. Group 2 will cover industry sectors adversely impacted by the pandemic. Group 3 will cover industries that have been most adversely affected including accommodation and food services, Arts, aviation, retail and tourism. 17.01.2022 An employer receiving JobKeeper payments can ask an eligible employee to work additional hours, but the usual requirements in the Fair Work Act apply. Any addit...ional hours worked need to be reasonable, and you can refuse to work unreasonable additional hours. If the only reason for a request to work additional hours is to match the amount of the JobKeeper payment, that is not likely to be reasonable. Your employer also needs to comply with any other terms and conditions of employment that apply to you (like the rules from your award, enterprise agreement or employment contract). Your employer must pay your usual base rate of pay for the additional hours, as well as any penalty rates or overtime pay that may apply. Under the general protections provisions of the Fair Work Act, its unlawful for your employer to force (or try to force) you to work unreasonable additional hours, or to tell you that you must work additional hours as a condition of receiving the amount of the JobKeeper payment. https://coronavirus.fairwork.gov.au//changing-duties-locat

16.01.2022 Good news for employers of part-time employees. The High Court has today overturned an earlier decision that ruled personal leave was to be 10 days a year for all permanent employees - part-time and full-time. This went against the widespread interpretation that personal leave accrued on the ordinary hours of work (like annual leave). The reality of the earlier decision was that a part time employee who worked only one day a week, would still be entitled to 10 full days of p...ersonal leave a year. The Court has today stated that the earlier ruling was impractical and unbalanced and has ruled that personal leave will accrue according to the hours worked.

Whilst you can encourage your workers to download the COVIDSafe app, you cannot direct your employees to download the app, even on a company owned phone. The Minister for Healths determination on 25 April 2020 expressly stated that a person must not require another person to download of have the app installed. ... This means that employers cannot direct or take adverse action against an employee who refuses to download the app.

Under WH&S legislation employers have a duty to provide a safe and healthy workplace. In times of COVID-19 this means taking a few extra precautions. You can maintain a safe work environment by, for example: ... cleaning the workplace regularly and thoroughly restructuring the layout of the workplace to allow for physical distancing, and limiting the number of people in the workplace at any given time. You must also provide adequate facilities in your workplace to protect your workers from contracting COVID-19. Facilities that are required include: washroom facilities including adequate supply of soap, water and paper towel hand sanitiser, where it is not possible for workers to wash their hands, and staff rooms that are regularly cleaned and allow for physical distancing. Provide workers with regular breaks to use these facilities, particularly to allow workers to wash their hands.

04.01.2022 Unfair Dismissal Increases How can you protect yourself against an unfair dismissal claim? The short answer is you cant. It is very easy for an employee to make an unfair dismissal application and cheap, only $73.20. So what have they got to lose? Theres no doubt COVID-19 has had a significant impact on Australian employment figures and now were seeing an increase in unfair fair dismissal applications being lodged. ... The increase in applications can be attributed to three primary reasons: The first one is purely a numbers game, a lot are out of work. People are scared and worried about their finances. Employers are / were scared too and felt like they had to make a quick decision for the viability of their business. The important thing is not so much how to avoid an unfair dismissal claim but proceed as if you are preparing for one. If you enact all terminations as if they will be scrutinised by the Commission then you are in a much better place than if you dont. The key points to ask yourself when enacting a termination are: Could the termination be considered to be harsh, unjust or unfair? Have I consulted with the employee, explained the issues or concerns and provided them with an opportunity to respond and / or improve? Have I considered all relevant factors including seriousness of the issue, ability of the employee to improve, length of service, previous work history, age, ability of the employee to get another job, mitigating circumstances? Have I given these and the employees responses due and genuine consideration? Have I followed due process? Enacting a termination can be difficult, but you dont need to go it alone.
