The result being if your employee is rostered for 12 hrs then the employee gets paid for 12 hrs of personal leave for 10 days or 120 hrs of leave not the current practice of many for 76hrs. The key points from the majority decision include: A "day" of leave is not based on an employee's average daily ordinary hours worked in a week, capped at a maximum of 38 ordinary hours per week (or an average of 7.6 hours per day). Instead, personal leave accrues in "days" over a year of service, and a "day" is the portion of a 24 hour period that would be allotted to work. For every day of personal/carer's leave taken, a day is deducted from the employee's accrued leave balance. If only a part of a day is taken, then the number of days in the employee's leave balance is reduced proportionally. While a day of leave could be converted into hours at any time, how many hours of leave a "day" will convert into will depend on how many hours are worked on the day the leave is taken. It submits that an entitlement to be paid for a day is an entitlement to be paid for the hours that would have been worked on that day but for the illness or responsibility as a carer. Concerns have been raised by employers that "On the Federal Court's interpretation, a part-time employee who works one day a week would be entitled to the equivalent of 10 days of personal/carer's leave a year." This will add to the torrent of claims that will soon make there a way to Court as law firms consider class actions for lost wages and further now that the matter has been appealed and a decision is clear, we can add for lost personal leave to that claim for employers who have shifts/rosters outside the 7.6 hrs per day.

03.01.2022 Fair Work Commission takes a dim view of Bullying even if it is not found to have been unsubstantiated later, the issue is; have you done all that you need too? When an employee makes a Bullying complaint it becomes a health & safety matter of sorts and the Commission will look at what aspects you have taken to consider the risk to the complainant. You should look at it from a Health & Safety Perspective (can I separate the person from the risk) if not how can I mitigate tha...t risk? Have you separated the two parties, was an investigation completed, what processes were undertaken during that investigation? There are steps and processes don't just give it to the Boss to sort out, because even some good people get this wrong in all manner of ways.
