23.01.2022 Free Advice to SMEs. The COVID-19 (Coronavirus) pandemic has created unprecedented business disruption. For businesses that have either had to close (due to government mandated directives) or businesses that have experienced a significant downturn in trading conditions, measures will undoubtedly now need to be taken to effectively manage your workforce. Different measures to consider include: 1. Taking paid or unpaid leave, 2. Modifying hours of work, 3. Modifying remunera...tion, 4. Adjusting roles to continue doing useful work, and 5. Redundancy. When implementing these types of measures there are risks including wage claims, constructive dismissal claims, general protections (adverse action)claims and even workers compensation claims. Importantly, there is no silver bullet in managing these issues and we find that even within specific businesses there is not a one size fits all approach meaning that workers are often managed on a case by case basis. 18.01.2022 From this week, the Fair Work Commission introduced changes that impose further obligations on Employers managing formal requests from Employees for flexible working arrangements. 08.01.2022 From 1 July 2012 the concessional contributions superannuation cap is $25,000 for everyone, regardless of their age. The change is because the: transitional concessional contributions cap for individuals aged 50 years and over expired on 1 July 2012, proposed new policy that will allow people aged 50 and over with low account balances to make concessional contributions up to $50,000 per year, without incurring excess contributions tax, has been deferred for two years u...ntil 1 July 2014. During August, the ATO will be writing to approximately 370,000 individuals who made contributions in 2010-11 financial year which were over or near the reduced cap. The letter will provide information about the reduced cap and how it may affect them. The intention is that the letter will give the employee enough time to review and alter their future contributions if they choose to. An employee receiving this letter may come to you for more information - and it is recommended you direct the employee to their tax agent or financial planner for advice. If your employees dont want to exceed the caps, the ATO suggests they should: review their salary sacrifice to super arrangements check the amount of their compulsory employer contributions confirm if other super contributions are paid by their employer from pre-tax income, such as administration fees and insurance premiums be aware that contributions to super claimed as an income tax deduction, such as contributions made by self-employed clients are also counted, and for members of a defined benefit fund, include their notional taxed contribution amount. If you are unsure of your obligations, call the HUMAN team for further advice.
