03.01.2022 Offshore Visa Application Concessions The Department of Home Affairs has announced that in early 2021 changes will be made to the program to allow certain offshore visas to be granted onshore. This is likely to be temporary only. The concessions will allow offshore child and partner visas (and prospective marriage visas) who have applied offshore and travelled to Australia during the processing period to have the visa granted while they are onshore. Child Visas It appears that the processing of offshore child visa applications is being transferred to an onshore office of the Department of Home Affairs to ensure these applications are moving forward, as children, impacted by the pandemic, can find themselves in vulnerable positions awaiting visa processing. We have already been advised by a number offshore missions that client applications are now being processed onshore. Prospective marriage to Partner Visa Due to delays in processing Prospective Marriage Visas caused by the pandemic a number of clients have decided to get married during this time. In these circumstances, when the Department is notified of the marriage the Prospective Marriage application will continue as an offshore Partner Visa application. No further fees are payable. This can be advantageous as it avoids the second government charge for having to file an onshore partner visa after being granted a prospective marriage visa and can save some time with regards progressing through to permanent residency as it eliminates on step in the process. If contemplating this course we would advise taking professional advice before proceeding. Given the announcement above with regards concessions, if you have filed an offshore prospective marriage visa and are now onshore on a temporary visa, if you get married you can convert the application to an offshore partner visa (309) and have this issued onshore once the concessions announced above are in place. Refunds A range of refunds are available to applicants if they have been prevented from travelling to Australia due to COVID.
