21.01.2022 Update from the FTA regarding Sydney Port. Maersk cease accepting bookings for Sydney destination cargo. The customer advisory notice from Maersk, issued earlier today, has been raised by Freight & Trade Alliance (FTA) and the Australian Peak Shippers Association (APSA) with the Attorney Generals office in advance of the hearing tomorrow at the Fair Work Commission, that was sought earlier this week by DP World.... The action by Maersk adds further weight for the Fair Work Commission to provide a decisive outcome in resolving the ongoing industrial action on the waterfront - it is essential that stevedore operations return to full capacity immediately to allow our importers and exporters to maintain and reach their respective markets and support Australia's economic recovery. All our discussions with shipping lines have indicated strong bookings leading all the way up to Christmas. However with the imbalance of containers entering / departing Port Botany there are already growing concerns that adequate equipment will not be available for overseas exporters, especially in China, to meet the demand. FTA members have already advised that their overseas agents have made bookings for 40 foot containers only to show up and find none available. We will keep members informed of any further developments. 17.01.2022 - () In response to the rapid expansion of BMSB throughout Europe and North America, the department has retained the seasonal measures to manage the risk of BMSB from arriving in Australia for the 202021 BMSB risk season. The department has used a range of scientific, intelligence and evidence-based information when setting the measures, including data collected from the 2019-20 BMSB season onshore verification activ...ities. The department has also worked closely with the New Zealand Ministry for Primary Industries (MPI) on the 2020-21 measures to ensure both Australia and New Zealand’s BMSB seasonal measures are consistent across the two countries (where possible). For the 2020-21 BMSB risk season, heightened biosecurity measures will apply to: *Certain goods manufactured in, or shipped from target risk countries, and/or *Vessels that berth at, load or tranship from target risk countries. The measures apply to goods shipped from 1 September 2020 that arrive in Australian territory by 31 May 2021 (inclusive). Goods shipped between 1 September 2020 and 30 April 2021 need to be treated and will be referred for intervention if they arrive by 31 May 2021 (inclusive). As with previous BMSB risk seasons, you must comply with these measures. Throughout the season, we will continue to review these measures based on detections of BMSB and the risk pathways and make any necessary adjustments. 08.01.2022 , , . Patrick Port Botany delays and more industrial action nationally. Freight & Trade Alliance (FTA) and the Australian Peak Shippers Association (APSA) note their public notice released 21 September 2020 stating:... "Last week, the Maritime Union of Australia (MUA) notified Patrick Terminals of its intention to take further Protected Industrial Action at Patrick Terminals Fremantle and Brisbane in addition to Protected Action already notified. The details of this action are listed below." "Currently, our Sydney Terminal is currently 12-14 days behind schedule, and it is forecast that the delays will increase due to the ongoing Protected Industrial Action. It is estimated that there is a backlog 35,000 containers waiting to be loaded or discharged at Patrick Terminals Sydney. Patrick Terminals in Brisbane and Melbourne also have berthing delays in excess of five days."

Freight & Trade Alliance (FTA) and the Australian Peak Shippers Association (APSA) have just received advice that there appears to be light at the end of the tunnel in the negotiation between DP World Australia and the Maritime Union of Australia. The below was issued by The Daily Cargo News (DCN) and includes commentary from Andrew Adam . DPWA Chief Operating Officer and Paddy Crumlin, MUA National ...Secretary This is all welcome news and we can only hope that if the new agreements are signed between the MUA and DPWA that other stevedores currently in negotiations work to similar outcome to the benefit of the Australian economy. A NEW workplace agreement is expected between DPWA and the Maritime Union by the end of the month. DPWA chief operating officer, terminals, Andrew Adam, said the Maritime Union’s decision to withdraw all industrial action at DP World Sydney has enabled productive negotiations at our Sydney terminal to resume. We anticipate being able to finalise an agreement at DP World Sydney in the coming week. We’re encouraged with the progress we made this week in Sydney, Mr. Adam said. The union issued a statement hailing what it called a breakthrough in negotiations, having last week suspended industrial action at the terminals as a show of good faith. MUA national secretary Paddy Crumlin said the breakthrough demonstrated proper application of bargaining was capable of resolving long-running disputes. By meeting together this week to bargain in good faith, DP World Australia and the MUA have been able to achieve a significant breakthrough, reaching an in-principle agreement that both sides hope to finalise by the end of this month, Mr. Crumlin said. After two years of difficult negotiation, this is a significant breakthrough that will provide industrial certainty at Australia’s largest container terminals. We are currently working with the company to turn this in-principle agreement into a final document that will lock in fair and productive outcomes for workers and the company over the next four years. Mr. Crumlin said efforts during the past week showed that when both sides sat down in a mature fashion, results could be delivered. This breakthrough outlines a path for other stevedoring companies to resolve outstanding issues, rather than beat up public anxiety in an effort to drive political agendas or attempt to gain unfair and cynical leverage in negotiations, he said. We remain committed to delivering increased and demonstrated best practice productivity on the waterfront, but only as part of a social contract with the workforce that delivers improved conditions and a shorter working week.
