21.01.2022 Dear Employers (and temporary visa holders) Australian Government Endorsed Event, subclass 408 visa (Event: COVID19): options for your employees (visa expiry wi...thin 28 days) The Department of Home Affairs have taken our industry advice on board. They have now included COVID19 into subclass 408 visa framework, as an Australian Government Endorsed Event. https://immi.homeaffairs.gov.au//australian-government-end If you have any Working Holiday Maker, 417/462 visa holders with visa expiries nearing 28 days or within that timeframe and they have no longer have an option to lodge 2nd, 3rd WHV (due to their age restrictions) for example, and unable to depart, this may be a solution for them for the time being. Additionally, if you have any Student visa holders, who completed their studies (usually 12 months) and have been working for you, and were not wanting to continue their studies further (to qualify for 2 years of study in Australia) may also use this pathway. This visa program is also open to the SEASONAL WORKER PROGRAM (SWP) cohort and other temporary visa holders unable to apply for other visa program. COVID-19 Pandemic Event category allows visa holders to: remain in Australia if you have no other visa options and are unable to depart Australia due to COVID-19 travel restrictions; and remain in Australia to assist in critical sectors including healthcare, disability and aged care, childcare and agriculture during the COVID-19 pandemic, and remain in Australia (usually) for upto 3 months or longer, but subclass 408 may be granted for upto 12 months. (If further information on timeframes would be available from the Department, I will advise). Working holiday makers who are employed in critical sectors including agriculture, health, aged and disability care and childcare will be exempt from the six month work limitation with one employer. Working holiday makers employed in critical sectors who haven’t completed the 3 or 6 months of specified work required to apply for a second or third Working Holiday Maker visa, and are unable to leave Australia, may be eligible for a Temporary Activity (subclass 408 Australian Government Endorsed Event (AGEE) stream) visa. This visa will allow working holiday makers to remain lawfully in Australia, and continue working, if they wish to do so, until they can return to their home country. Those already in Australia with the Seasonal Worker Program whose visas are expiring, will be able to extend their stay in Australia by applying for a Temporary Activity (subclass 408 Australian Government Endorsed Event (AGEE) stream) visa. All international travel movements undertaken by visa holders (arrivals and departures). We estimate records relating to approximately 10 million individuals will be obtained each financial year. The data will be acquired and matched with ATO data holdings to identify non-compliance with obligations under taxation and superannuation laws. John Hourigan FMIA, National President of the MIA said today that ‘the MIA recommended to the Government in early January 2020 that working holiday visa conditions be relaxed to allow backpackers to work in both volunteer and paid positions to assist local businesses, workforces and towns to rebuild these areas.’ Working holiday visa conditions did not recognise work as a volunteer as an entitlement leading to further visas or allow backpackers to work for longer than six months for one employer. Nevertheless, many backpackers, many of whom are qualified tradespersons, were quick to rally of their own accord to help those affected by the bushfires. Working holiday visa holders will now be able to work in a greater number of roles and in construction in disaster declared areas. They will be able to work continuously for one employer for twelve months, a necessity for longer term rebuilding projects. These roles and their work will be counted towards the specified work requirement in regional areas, that entitles them to apply for further working holiday visas. As well as bolstering workforces in these locations, these backpackers will also bring much needs revenue to these areas. The advertisement would need to run for at least 28 days in the last 4 months. These arrangements commence on 30 September 2020. If you are planning to nominate any employees after that date (or in the near future) for the above mentioned visas, can you please ensure that you at all times have 3 (three) advertisements running and one of those advertisements MUST have been running on Jobactive.gov.au website. Thank you.
