19.01.2022 Migration Review Tribunal & Australian Visa Refusal / Cancellation Has your visa application been refused or your visa cancelled? You may be able to appeal this decision to the Migration Review Tribunal (‘MRT’).... The MRT can make a decision in your favour and decide that the Department of Immigration & Border Protection's (DIBP) decision is incorrect and send the matter back to the Department to be reconsidered. 17.01.2022 Its been revealed that the government's 'think tank' known as the Productivity Commission has been investigating a price-based immigration system that would use entry fees as the primary determinant for who gains entry to Australia, in other words selling the right to immigrate to our country. Under such a radical scheme migrants would no longer be accepted based on their skills or family connections but on how deep their wallets can go. Question: Is this a viable option for our national immigration policy? Is it equitable to only allow the rich entry onto our golden shores whilst closing the proverbial door on the poor & genuinely needy? Parades, lion dances, shopping, food fests, exhibitions and cultural events are some of the key elements of Sydney’s Chinese New Year Festival. 05.01.2022 Migrants now have to Pay More as a result of the the Federal Budget for 2015-16! With the release of Federal Budget last Tuesday, it was revealed that application fees for most visa types will be increasing from 1 July 2015. Below we've provided a brief overview of those visa classes affected: ... *Offshore Family Migration Visas *Off Shore Partner Visas *Off Shore Prospective (fiancé) Visas *Aged Dependent Relative *Remaining Relative *Distinguished Talent *Former Resident *Significant Investor Visas (which faces a 50% increase) *Resident Return Visas *Working Holiday and Work and Holiday Visas *Temporary Work Visas such as the Subclass 401, 402, 403. One thing is clear regarding these increases and that is the significant difference between the modest increase in skilled migration fees, as compared to the hefty increases to family migration fees. What this evidently reflects is the current government's focus on skilled migration over family migration. Please note that in order to avoid the increase in application fees, you should lodge your application before 1 July 2015. 02.01.2022 The Australian federal government has vowed to reduce regulation while strengthening the integrity of Australia's 457 skilled visa program, after it released its response to a review into allegations of rorts and abuse in the system. The Government has adopted most of the 51 recommendations from the review. One recommendation - to change the English language testing requirements for the 457 visa - will see the rules change for applicants who now have to average a score of fi...ve across the four components, instead of successfully passing each one. The move has been criticised by trades unions who say the new system raises safety issues. In essence these government changes will decrease the level of red tape involved in the 457 visa schemes and despite the concerns voiced by trade unions, we at Impact Lawyers & Migration Agents believe that the changed English language testing requirements allow greater flexibility while still maintaining adequate standards and should be supported. However, the government has not accepted all recommendations with redundant regulations such as labour market testing still in place. 01.01.2022 Changes to the English Requirements for 485 and 457 Visas. On 18 April 2015 changes came into effect for the English language requirements for Graduate Temporary Subclass 485 visas and Temporary Work (Skilled) Subclass 457 visas. The changes now allow for average band scores to be accepted. For example, previously for 485 visas a minimum of 6 in each band was required, now an average band score of 6 in IELTS will now be accepted. ... These changes certainly remove much of the frustration for applicants seeking to apply for these types of visas since it's been claimed that many applicants had sometimes sat repeatedly trying for the required minimum score in each band. There are also some other important changes to the 457 program which have now come into effect, including: 1. Decreasing the minimum salary for exemption from the Market Rate Salary requirement from $250,000 to $180,000 and; 2.
