11.01.2022 FAMILY LAW MATTERS Separation is a highly emotional time and many parties become vulnerable, confused and frustrated when making big decisions about the children and property settlement. Making private arrangements and agreements with your ex-partner is not always possible. Accessing the Family Court and lawyers is time-consuming and costly, but sometimes necessary. ... If you need to engage with a mediator for the purpose of Family Law Matters, here are a few tips to help you choose. A FDR practitioner is accredited under the standards set out in the Family Law (Family Dispute Resolution Practitioners) Regulations 2008 and is regulated by the Attorney-General's Department. Accredited FDR Practitioners can be found on the Govt's FDR Register - fdrr.ag.gov.au Ask your FDR Practitioner if they are approved to issue certificates under Section 60i of the Family Law Act 1975, commonly known as a Section 60i Certificate. FDR Practitioners should always keep any information discussed including scheduled appointments with you confidential from any other party including the other party or any lawyers unless you have provided written consent. A FDR Practitioner can not provide you with legal advice, write consent orders and must remain a neutral third party at all times. You should always be provided with time to consider any agreement or arrangement BEFORE signing. If you feel rushed or pressured, ask for some time and seek legal advice if required. All FDR Practitioners and mediators are obliged to provide you with the details to a complaint mechanism with an external complaints body prior to mediation. 07.01.2022 NEW COMMERCIAL TENANCY LEGISLATIVE CHANGES The WA Government has passed a new law to help commercial tenants and landlords reach agreements about rent during the COVID-19 pandemic. The law was passed in two parts:... Part one: Commercial Tenancies (COVID-19 Response) Act 2020 (21 April 2020) Part two: WA code of conduct (29 May 2020) These two parts of the law work together to ensure businesses survive the economic downturn associated with the pandemic. They implement the key principles of a national code released by the National Cabinet in April. They specify the actions small business tenants and landlords can take in regard to commercial tenancies during and following the crisis, and how they should negotiate an agreement. 07.01.2022 Not all neighbours are like Wilson. Are you frustrated at the loud music? Have you been asked to pay for the repairs of the fence? Sick of the neighbours pets in your yard?... Do you have to keep asking for the overhanging tree to be maintained? Check with your Shire for local bylaws. If the issue can't be resolved with your neighbour talk to one of our Practitioners. Mediation may be an option to meet with your neighbour and express your concerns and to highlight the issues at hand. Don't let the issue become an ongoing war. You are likely going to be neighbours for a long time.
