22.01.2022 Just a quick update for my clients that are concerned their settlements may be delayed or cancelled.... Indeed Convey is still operating at full capacity all 11 of us. I purchased laptops for the whole team so they can work from home which will more than likely start to roll out this week. The beauty of PEXA is that we can settle your property on a laptop at home. ... While we have internet, emails and our mobile phones Indeed Convey will continue as normal. Response times may be slower than normal as we can only call and receive calls on mobiles (once we start working from home) but rest assured I have no intention of letting any of my clients down. Your voice was always so calming. You knew what to say and your passion and never give up attitude was an inspiration. ... We are so sad that we could not say goodbye as we would have loved to but we are grateful that you are no longer in pain. Link below and also a few relevant ones here; https://www.business.vic.gov.au//rental-hiring-and-real-es Are removalists able to work under Stage 4 restrictions? Yes. A removalist can be used to support vacating a property under Stage 4 restrictions.... Can a person commence a lease during the 6-week period that is move in? If so, does this extend to non-residential property? Yes. You are still able to move to a new house or non-residential property if you had already arranged to move, but the curfew hours still apply. You should also take extra steps to stay safe including wearing a face covering. You may also commence a new lease if it would be unsafe not to do so. What is the intention of the different references to private inspection and what does a private inspection extend to? We assume this is an inspection for Condition Reports, vacant possession etc. Services related to property settlement or end-of-lease are permitted to occur (for example condition reports). The property must be vacant for end of lease tasks to occur. Inspections to view new properties can only happen virtually. Can real estate agents complete non-auction or inspection real estate tasks such as, condition reports, repairs or inspections? Services related to property settlement or commencement/end-of-lease can continue to operate. This includes condition reports and cleaning, only once the property is vacated. Other end-of-lease activities should be minimised wherever possible and done online.

16.01.2022 We have had a few clients call to ask if they can still attend a final inspection prior to their settlement. Yes we are in Stage 4 Lockdown however the DHHS website has confirmed that property settlements, end of lease and removalists are permitted industries. Conducting a Final Inspection with your agent whilst abiding by Covid-19 restrictions of safe social distancing and wearing a mask at all times is allowed.... The purpose of the final inspection is to make sure any special conditions are met and that the property is in the same state as the time you signed the Contract of Sale. If there is any significant damage or you have any concerns at the inspection you should take photos and contact our office immediately. 13.01.2022 Land tax reduction for eligible landlords ..... Landlords who provide tenants impacted by COVID-19 with rent relief may be eligible for a 25% reduction on the propertys 2020 land tax. This relief is also available to land owners who are unable to secure a tenant because of COVID-19. These landlords can also defer the remainder of their 2020 land tax to 31 March 2021.... This relief is available for residential and commercial properties, however, for commercial landlords to be eligible, the property must be rented to a tenant with an annual turnover of up to $50 million, and the tenant must be eligible for the Commonwealth Governments JobKeeper Payment. Instructions on applying for this reduction will be published on the State Revenue website in the coming week. 11.01.2022 Commonly Asked Questions When can a buyer Cool off and when does the time commence? When purchasing property in Victoria, Section 31 of the Sale of Land Act 1962 states that buyers are entitled to a cool off period. They have 3 clear business days FROM THE DATE THEY SIGN THE CONTRACT in which to change their mind and withdraw from the contract of sale.... The sale must be for land other than land used primarily for commercial or industrial purposes, and land larger than 20 hectares used primarily for farming. In addition to these restrictions, there is no cooling off right if: The sale is at or within 3 clear business days before or after a publicly advertised auction; The parties have previously entered into a contract for the same property in similar circumstances; The purchaser is an estate agent or a corporate body (e.g. a company); NOTE: It is most important to remember that the cooling off period starts when the PURCHASER first signs the contract, even though the vendor may not sign until a few days later! Cooling off costs money! Cooling off is an inconvenience to the vendor. After all, the vendor has been told that the property is sold and now finds that the sale has collapsed. 10.01.2022 During the past 6 weeks we have received many calls and emails from clients concerned with what affect the COVID-19 pandemic will have on their settlements, finance and overall progress of their conveyancing matters. We have had a 92% success rate with our settlements and only a small number falling over due to slower processing times with some banks and some clients going into self isolation and unable to locate titles or complete the compulsory face to face ID check. 10.01.2022 There is still plenty of activity in the market, despite the high Covid numbers and Lockdown Mark 2. We are seeing many contracts that are SUBJECT TO certain conditions being satisfied. One of the more common (and prudent) is the Contract being subject to a satisfactory building and pest inspection.... The clause allows you to get written reports from qualified building and pest inspectors about the property. Building and pest reports can identify a number of issues about the property. These range from minor problems like a leaking tap to serious issues such as termite infestation or structural damage. A *correctly-worded* building and pest clause may give you the right to withdraw from the contract if the report isnt satisfactory. BUT beware, not all special conditions are created equally!! 07.01.2022 Why do I need an experienced Conveyancer when purchasing a property? After 24 years in this industry I have seen a LOT but by far Covid-19 is the most severe event to impact the property market and our economy. Now more than ever you need an experienced professional on your team to help guide you through this unusual time and the changes it has brought about in the conveyancing world. A Conveyancer is engaged to initially conduct a thorough review of the Contract of Sale and ...Vendors (Section 32) Statement prior to the purchaser signing on the dotted line. At Indeed Convey we provide a comprehensive written report about the documentation as well as some information pertaining to the history of the property and the surrounding area. The importance of the review before signing the Contract is the ability to negotiate terms to protect and also benefit the purchaser. In addition we can often balance out some of the special conditions that are sometimes weighted in the sellers favour. The other benefit of a Contract review is discovering issues such as illegal renovations or combustible cladding that may be the reason NOT to go ahead with the property. Being armed with this information before the purchaser puts forward their offer is often invaluable! Once a property is purchased a Conveyancer acts on the buyers behalf to co-ordinate the legal work involved with a property transfer. We liaise with the real estate agent, the buyers advocate/agent, the finance broker, the bank and also the vendors legal representative. We are your middle-person! We co-ordinate all the legal forms that are required for the State Revenue Office and also Land Registry and the PEXA electronic settlement platform. We arrange settlement and also take care of the necessary financial adjustments at settlement. A huge part of our job and responsibility is the Due Diligence between Contract and Settlement so researching the property and comparing our searches to that of the initial Contract of Sale and Section 32 Statement. 03.01.2022 Different forms of land ownership commonly asked question JOINT TENANTS TENANTS IN COMMON If two or more people purchase a property together, they can own it either as tenants in common or as joint tenants.... Joint Tenants own a whole share, equally together. Tenants in Common can specify the shares in which they hold the property (ands this can be equal or unequal). If a tenant in common dies, their interest in the property is an asset of their deceased estate.
