17.01.2022 Redundancies in the time of Covid: To consult or not to consult? In Aimal v Battery Energy Power Solutions Pty Ltd [2020] FWC 3034 (10 June 2020) [http://ow.ly/aguI50A5FSQ], the FWC reiterated the need to consult where an applicable award or EA requires consultation, even if it would not change the outcome. Otherwise the employer may be exposed to an order for compensation in the interests of a 'fair go all around'. The FWC also pointed out that notice can be triggered at t...he time of consultation. In another decision that considered redundancies in the current climate, Wilson v Monizumi Pty Ltd [2020] FWC 2713 (27 May 2020) [http://www.austlii.edu.au//viewdoc/au/cases/cth/FWC/2020/2] , the FWC accepted that there is no requirement for a business to wait until a possible financial crisis has actually manifested itself before it takes action to protect its' business interests. Also, a position will be redundant even where some of the employee's duties need to be done after the dismissal. See more

14.01.2022 The Fair Work Commission has today issued its decision on the National Wage Case, determining to increase the National Minimum Wage by 1.75%. That equates to an increase of $13.00/week or $0.35/hour. The new National Minimum Wage, effective from first full pay period after 1 July 2020, will be $753.80 per week or $19.84/hour. The same increase will be applied to Modern Awards from the first full pay period after 1 July 2020 (Group 1 Awards), 1 November 2020 (Group 2 Awar...ds) or 1 February 2021 (Group 3 Awards).
